NFL files its opening brief in Deflategate appeal.

Actually, since no notes were made available to anyone outside the league offices, we don't know if they ever interviewed those guys. All we know is that they didn't say anything incriminating enough to end up in the Pash/Wells report.

Have you ever heard anyone from the media bring up this POV?? Do you think if they were interviewed they would have said something??

My bet is they completely missed this and made the narrative fit the conclusion..

For multiple reasons, the NFLPA is poised to argue that the Black Sox scandal is a poor example to justify Goodell’s punishment of Brady. First, the Black Sox scandal involved direct proof of wrongdoing, unlike Deflategate where no direct evidence links Brady and where the Ideal Gas Law and confusion about how the referees tested the footballs cloud the indirect evidence. Second, the Black Sox scandal involved a conspiracy to throw games, not gain what would have been a modest and likely inconsequential advantage with slightly under-inflated footballs. Third, the Black Sox scandal occurred in an era before there was collective bargaining between owners and players. This was a time when owners unilaterally imposed employment rules on the players. Those days and their associated legal regimes are long since over. Indeed, when judged by the NFL, Brady was protected by a collectively bargained set of rules that are subject to federal labor law.

No, but I don't expect any level of competence from the media, so that doesn't mean anything to me.

If I were one of those guys, on the fringes of getting/keeping a job, I'd be trying to stay as clear as possible from this whole thing. Don't want to get blackballed for coming out in Brady's defense.

I tend to agree. Once they felt they had enough to spin the narrative they wanted from the texts, they didn't really want to dig any deeper. Better to appear to have next to no evidence than to accidentally find exculpatory evidence. I was just pointing out that it's dangerous to assume that we know all the ways we were screwed over by the league.
 
I believe the NFL opens the actual findings of the Wells-Pasch report to discussion by writing this in their brief, which means the CA2 could actually rule on Goodell's impartiality by questioning the gages used.

I've seen ads that make similar type comparisons, but they weren't needles in the photos. :D

There you have it, folks. According to the NFL:

Deflating a football = Deliberately throwing a world series.

The NFL makes a number of stretch comparisons in this appeal filing that do not address the grounds for an appeal that Judge Berman made an error in procedure or applied the relevant statutes incorrectly.

The passage about rewarding McNally and Jastremski "handsomely" by giving them footballs or jerseys was bizarre. They suggest this is proof that they deflated footballs, as if everybody that Brady signs for is in a quid pro quo relationship. At camp when Brady signs for the kids, he stays a long time. He's also very generous with participants on the Cape at his Best Buddies rides. Does that mean they're all cheaters?

I expect the NFLPA brief to be much more concise, on point, and dismissive of the NFL brief.
 
Why on Earth would he file in NY?

Offhand I don't know if MA has some kind of "borrowing statute" or what kind of "choice of law" analysis a MA court would use in a defamation action but since Brady was living in MA when the defamation took place he should have no problem getting a MA state court venue (of course, it may be removed to federal district court, but that's another matter).
Wasn't implying he would, just using it as a frame of reference. I should have said that most other states are one year, some two but MA is three which allows him the luxury of playing this out....
 
I'd think Mallet would have to really think his career was done for that to happen. And by all accounts this guy seems somewhat convinced of his greatness.

Sadly not outside the realm of possibility though.
When it comes to maliciousness, 'm not putting anything past those guys... They already orchestrated a frame job, science be damned...and Mallett doesn't appear to be the sharpest of tools.. If he ever realizes he is toast in the league and they come knocking,,,,,,,,,,,,

Looks like he's waiting until the appeals process plays out (and the NFL season) before deciding what to do about that claim.

To think, Brady could be MVP this year and win his 5th Superbowl then sue the NFL and Commissioner for defamation. Mind boggling.
 
IMO a slippery slope here is the NFL telling one court that another court(judge) exceeded their jurisdiction, particularly as the NFL filed the initial litigation in the court to affirm its decision..
Sort of like telling the court, "your decisions don't matter"....
Court: "then why did you run to us to validate your decision?"

*No where in the NFL's 59 page brief did it mention the Ideal Gas Law...science doesn't matter..
* It did say that the Colts were under inflated according to one of the gauges......
* Wells said Brady cooperated but Goodell said he didn't..league now says he didn't....
* Why doesn't the league blame the Hindenberg, Kennedy assassination and Jimmy Hoffa's disappearance on him while you're at it..?? After all, Hoffa disappeared from Michigan and Brady went to school there..so it's more than likely,....So what if he wasn't born for two more years......

If I'm an owner, I ask how much is this witch hunt costing us?????
Business schools will be studying this for years as an example of "sunken costs" theory....
 
I wanted to limit the number of threads I post on a daily basis, but this seemed like an important topic to bring up, and wasn't something that I felt could be overlooked or waited upon.
You've made 3600+ posts in 226 days for an average of 16 a day.

With twice as many positive ratings as posts I'd say you've no need to explain yourself. You may be guilty of being a little over-enthusiastic but your respectful and informative. The fact that you recognize your a fairly prolific poster is a positive to me.

I, for one, appreciate your contributions. An active board is a good board IMO.

Regarding the relationship between Kraft and Brady, I find it interesting that Brady has made comments regarding his future, 10 years into the future, without a caveat in regards to team loyalties. Kind of tells me that Kraft and the Greatest have worked it out since then, no?

While the nyjfl ain't a rocket science firm and mallet may be a punk; there are 30-31 teams besides Houston (or Houston and NE). Even Vick got re-hired. I don't think Mallet is worrying about not being hired by anyone. Maybe worrying about not being hired by a contender or worried about being hired by a garbage case (sf, clev, jax). But somebody would take him, probably even above vet minimum.

And all he has to do is have the agent tell teams he just acted up deliberately to get out of a bad situation and it won't happen in their town. Some desperate owner/gm will believe.
 
How haven't the equipment guys given an interview yet? And when do they file their defamation suits. I want internal NFL emails to be court ordered right away

It has a desperate and sad sense of jealousy and inferiority plus the unbridled hubris and arrogance of 345 Park Avenue written all over it. It has nothing to do with political correctness.
