I disagree that people are going to get back to bashing Brady because of this. People are tired of this shi.t even if they think Brady did something. Especially now that Brady is playing out of his mind and showing how stupid it all was. At the same time Greg Hardy doing his best to be as awful a human being as possible is making Goodell look even worse. The public is ready to t-off on Goodell. The media is already on the Brady bandwagon because of how well hes playing, they wont quickly jump off an obvious winner for Goodell.
 
Disagree. The Deflategate specifics of this case are stupid, but the case itself touches on pretty important aspects of labor and arbitration law. Forget about all the football stuff and the bogus Wells report, etc., and at its core it's about how one-sided an arbitration agreement can be, it's about what unwritten legal concepts are incorporated by reference into a CBA, etc., etc.

Think of what this means for anyone subject to a CBA or an arbitration agreement if the NFL's "there is no right to any basic fairness whatsoever" position is upheld.

If this is appealed to SCOTUS I expect tons of amicus briefs in favor of the NFL from a whole bunch of companies and trade associations and a whole bunch in favor of the NFLPA from unions and left-leaning (and beyond) organizations.

Good. The arbitration hearing process is horse-poo anyway. I wasn't to smart on such things, now I am. No one, and I mean no one should have the authority to have unassailable rulings. No one. This is the pinnacle of why the arbitration process needs to be overhauled.

An arbiter had better have his sh*t in order before he issues a ruling. The I can do what I want mentality (Goody) has no place in society.
 
Early on, I would accepted the judgment of an independent arbitrator. I can't figure out whether Goodell heard the case himself because he knew the case couldn't stand the scrutiny of an independent party, or if he's just a bully who just believes it's true all facts be damned.

Yes, but they won't decide issues he didn't address.

They will send it back to Berman and then only if they rule in the NFL's favor on all issues addressed by Berman in his decision. The NFL won't get beyond law of the shop, IMHO.
 
I hope that Goodell realizes that in the end, Brady is going to remember as the greatest NFL player of all time, the Patriots the greatest Dynasty. On the other side of the spectrum, Goodell will remembered as the worst commissioner in US sports history.
 
Wait, someone clarify this for me. Are they now saying that all 4 of the Colts balls were within the legal range when measured even though that directly contradicts the Wells Report where 3 of them were specifically measured below 12.5? Is that the argument they are now making? Really?

Kessler better have a response ready to go tomorrow. I'm sure he knew this was all coming.
They used their lawyer speak and said all the Colts balls measured ok if you used the higher reading gauge.
 
I might have missed something but why are the Colts balls passed using the higher reading gauge and the Patriots balls are condemned using the lower reading gauge. I don't remember anything specific in the report, but wouldn't all balls be measured with the same gauge pre-game?

Per Florio, "the NFL contends, and it was devised to avoid detection by league officials." Damn that Brady is good. League officials still haven't detected any wrong doing - they've been guessing all along.
 
Federal court is going to laugh this right out of court.

It's absolutey laughable. They are lucky Judge Berman stopped when he did and didn't tell them what he really thought about the case and some of the other findings he left out. I'm sure everyone already knows behind closed doors what they are.
 
how has the nfl changed its own narrative from more probably than not to definitely schemed and is public knowledge brady likes deflated balls because of some comment from mcnally after brady complained about over inflated balls and asked to show the refs the rulebook.
how can anyone having any common sense infer that the QB asking to show the rulebook to the refs be part of a grand scheme for "years" . And if it was public knowledge why didnt the nfl do anything ? Now their entire appeal is absolute facts that mcnally went into the bathroom and deflated the balls.
Really sickening.

Either way, he'd be unfit to be the final verdict of any ruling for any corporation or even pick-up ball.

I used to care but after seeing Brady play these past few weeks I hope they keep fighting him on these appeals and bring in even more lawyers. It would also be wonderful if this lights the fire under the mediots so they can start spouting deflategate nonsense again. They haven't been doing a good job of it lately. We also need more rumors about his dog. I love watching Brady play with chips on both shoulders.

Arbitration law says that courts must show deference to arbitrators; that's to prevent Arbitration from just being a prologue to lawsuits.

OTOH, it does not allow an arbitrator unlimited power, or the right to run roughshod over the notion of fairness.
