2nd Circuit Agrees to Expedite NFL Appeal - orals no earlier than 2/1/16

I'm surprised the court agreed to this. There must be literally millions of more important cases for the court to work on
 
Five years from now, the NFL will be asking the Supreme Court to uphold the four game suspension.

Once the 2nd circuit renders its decision can there be more appeals? And if it went against TB would he and the NFLPA appeal again?

The NFL can appeal to the Supreme Court. The Supreme Court, however, does not have to hear the appeal (they have discretionary review).

I would assume the NFLPA could do the same if they chose. Do you think they would if the 2nd Circuit overturns Berman?
 
I was channel surfing and came across the Lou Dobbs show on Fox Business. Him and 2 lawyers were talking about the appeal and deflategate. Dobbs just ripped into Goodell and the NFL office..... I mean RIPPED into him. Used words like petty, incompetent, spiteful, a great sport that has 32 owners thinking poorly when picking someone like this to run the show, Goodell is the problem here. (not verbatim but this is basically what he said).

From a national, non Boston, media standpoint this is the first media person that actually has seen it/called it for what this exactly was: a witch hunt conducted by spiteful incompetents who don't deserve the positions they have.

Depends on exactly what the CA2 panel rules.

Berman was presented with (IIRC) 7 reasons why he should vacate the suspension. He ruled on (IIRC) 4 of them (all in favor of Brady) and then concluded that given those decisions there was no need to even consider the rest (it is pretty common for judges to do that -- once they've decided enough to decide the case they won't reach other unnecessary stuff).

The CA2 panel can do a bunch of things:
  • Uphold all of Berman's rulings and do nothing else, then:
    • Case is then over at CA2 panel level
  • Uphold some, but not all of them, then:
    • Remand the case back to Berman, or alternatively
    • Decide some but not all issues not considered by Berman and remand to Berman, or alternatively
    • Decide all issues not considered by Berman, thus ending the case at the CA2 panel level (according to a lawprof friend that is "disfavored" appellate behavior).
  • Uphold none of them, then:
    • Remand the case back to Berman, or alternatively
    • Decide some but not all issues not considered by Berman and remand to Berman, or alternatively
    • Decide all issues not considered by Berman, thus ending the case at the CA2 panel level.
Regardless of what the CA2 panel decides, whichever party or parties aren't satisfied by the decision can ask the entire CA2 to rehear the appeal en banc (meaning all the CA2 judges participate). It's unlikely that would be granted. If it were granted the panel decision would be voided and then the en banc court would eventually do one of the same things from the list above.

Once en banc is either refused or happens and renders a decision we are done at the CA2 level for the time being -- we have achieved a final decision from CA2.

Then any party or parties that are dissatisfied with the final CA2 decision can ask SCOTUS to hear the case. If SCOTUS refuses, then the final CA2 decision -- whatever it is -- becomes final.

However, that doesn't necessarily mean we're done since that final decision may include a remand to Berman.

If so, Berman will hold more hearings and (a) try to find alternative grounds to continue to stick with any of his rulings that were overturned from above, and (b) now consider for the first time any of the previously-unconsidered issues that were not decided by courts above him.

Then whatever Berman decides from that round of hearings goes back up the same food chain should a party or parties choose to appeal it. Depending on what CA2 and possibly SCOTUS decide this second time around that could (and probably would) finally end it all or it could come back to Berman yet again and we could get a third Berman decision and a third appeal.

Don't let the case's humble beginnings (possible deflation of some footballs) fool you. This is actually a very significant labor law case. A win for Goodell would change the arbitration landscape significantly, and could result in either calls for major reform, or a revolt against arbitration in general.
 
ESPN's Chris Mortenson is reporting that the voices in his head have told him that Roger Goodell has decided to hold oral arguments in the Deflategate appeal at halftime of Super Bowl 50. If the NFL loses on appeal, the Commissioner has indicated that NFL Counsel Jeffrey Pash will be spiked in the end zone by Patriots Tight End Rob Gronkowski.

After already being embarassed and "butthurt" one might think that the NFL should cut its losses and move on to more important things, but for some reason they have a massive hard on for Brady/Belichick and will continue unabated until someone somewhere agrees with them..

I still think BB is the target and Brady is "collateral damage".. the league that prides itself on parity is failing miserably when it comes to the Patriots.. this is not supposed to be happening.
 
This stopped being about deflated balls or Brady a long time ago. This was a power grab by the Commissioner to reverse all previous court losses and to increase and cement his interpretation of his CBA powers. Well he listened to Munson and it backfired.

He now has no choice but to see this through because the Berman decision basically gutted his interpretation of his CBA power. This is a major labor law case that has implications for other sports as well.

He will lose again.

Not a chance in hell.

Every owners team is being compared to the Patriots and they do not want to see another Patriots Super Bowl. The deflategate off season didn't work as Brady was prepared for the regular season as ever.
 
This whole "deflategate" fiasco is leaving a heap of delegitimized reporters in its wake...

Made me think of this scene from Monty Python & The Holy Grail. With the NFL playing the role of Sir Launcelot. The townspeople represent the fans, the press, the owners, the players, etc. (Relevant part starts at 2m mark).

They court has to hear the appeal. It's just a matter of when.. As for them expediting it, both sides agreed, so they probably saw no reason not to grant the motion.. Probably with the thought of, "Why drag this on longer than necessary"

How can you think that BB is the target and Brady collateral damage? That totally ignores the fact that BB and Co. were exonerated by Wells. It also ignores the fact that Brady was the one who's name was on the lawsuit against the NFL during the last CBA talks..
 
Oh brother. A breathless Washington Post article claims that Brady could miss the Super Bowl if things fall a certain way because of this expedited appeal. As if Brady's side would have pushed for this if there was a chance that could happen.

No way Brady would miss the SB.. No way the CA2 renders a decision within 4 days of hearing oral arguments..
