The US Court of Appeals for the Second Circuit has agreed to expedite the NFL's appeal of Berman's decision.

The briefing schedule will be:
  • NFL opening brief due by 26 October
  • NFLPA answering brief due by 7 December
  • NFL reply brief due by 21 December
Oral argument will be set "as early as the week of February 1, 2016".

So we may well get oral arguments during Superbowl week. This also guarantees once and for all that no decision will be made before the end of the full 2015 season.

 
It would be awesome if fresh off a SB win, Brady and his team proceed to kick Goodell's butt for a second and hopefully final time on this nonsense.
 
I really hope that the 2nd Circuit holds the oral arguments AFTER the SB. Just so that distraction isn't there. Regardless of who is playing in it..

I thought in their original request they both asked for orals in January? Maybe the 2nd Circuit is wiser than both.
 
A lot will be made of that 2/1 date in the NFL media, like its some kind of a superbowl stick to wave over the Pats' head. But the fact is that date is merely a starting point for consideration. It is far from a firm date for the start of oral arguments. Besides Brady has nothing to do with this appeal. The only ones being disturbed will be the lawyers.

In all likelihood the superbowl will be well over before oral arguments start. Remember the SOLE purpose of the expedited hearing is to get this all settled BEFORE next year's camp. This is more for Brady's benefit than the League's. It is a good thing.

Don't forget there is a reason the NFL is 0-5 in Federal Court. Also consider this, the NFL had better cases in ALL the previous loses, than they do with the Brady case.

A lot, and it doesn't appear so.

We'll see, there's lots of time between now and then.

No. They requested the expedited hearing for the January 2016 session. It's a matter of what is already on the docket as to when they actually get heard..

I assume that this Carton clown has offered a public mea culpa for reporting false information from unnamed sources. :rolleyes:

Funny thing is this is only halfway a joke. I don't doubt that something like this could happen, though I don't know what the statute of limitation is on some ridiculousness like this. I can't even believe the NFL is still pursuing this BS. But then again . . .
 
Darth Sidious will preside. His opening remark to Goodell* and the NYJFL* team:

"Let the butthurt flow."
