Ummm, that's pretty much what any appealing party is going to claim. Appeals are, by definition, an appeal of determinations and interpretations of law. So "the judge interpreted the law wrong" is, at the bottom, the claim all appeals pretty much make.

Sucks, that we have to wait 3 or more months to see Goodell getting
his ass kicked again.
 
That was not an option for them. I can't recall the exact number of days, but if they were going to file a notice of appeal they had to do it within (IIRC) 35 days of September 3rd. And once they filed the notice of appeal they had to file the "Civil Appeal Pre-Argument Summary" thing within two weeks -- hence by today.
If they had waited "a few months" they would have been barred from appealing at all.

Now, nothing that's happened so far prevents them from asking for the appeal to be dismissed should they change their minds.

The next interesting thing will be tomorrow, which is the deadline for asking for an expedited appeal and proposing a briefing calendar. If they don't file anything the defaults (detailed in a different post here and findable a few days ago in Wallach's tweetstream) take over. The most important date of the default schedule is that the final pre-argument brief would be due 11 December. Oral arguments would then be set for sometime after that.
You maybe right, but I was led to believe that they had just a short time to file for a fast track appeal, whose limit has passed. However I thought they had months to decide if they want to file for a regular appeal which could take several months to a well over a year to adjudicate

Could be that we are both wrong, but I'm not worried because in short order, someone with more legal knowledge than either of us, will come along and give us the correct answer. We only have to be patient. ;)
 
Even though the NFL will not win their appeal, they have to at least attempt to reverse Berman's decision to avoid precedence from being set with future cases related to the CBA and discipline from Goodell. I can't fault them for that even though winning is definitely a long shot!
 
So the NFL's argument to Berman saying "you interpreted the CBA wrong" is "you interpreted the law wrong"?

Good luck with that one, Roger. Seems like legal equivalent of "I know you are, but what am I?"
Really, though, isn't that the basis of all judicial appeals?

So let me get this straight, R Rice knocks out his wife in an elevator with Smoking Gun Video, A Petersen has to use a stick on his young son to discipline him Smoking Gun Picture, Goodell* NFL* go after Brady for air pressure that there is NO PROOF, Smoking Gun and is dragged through coals over 'More Probable Than Not' conclusion and league wants to appeal Berman's Ruling saying that it was more important than RR & AP?! I'd say their priorities are outta wack, run by a wack job.

There is nothing appealing about the NFL*.
 
I think The NFL* is trying to get into TFB's head. Good luck with that. He owns the nfl*.
 
Roger's integrity of the game:

Smashing defenseless guy's head into helmet: 0 games

If the people behind that Concussion film really wanted to draw attention to that incident, the non-reaction by the NFL and their movie, start putting the clip of Jones smacking Cooper's head against the helmet in the trailer.

When the NFL squawks and orders them to remove it, the damage will have already been done.
 
Roger Goodell needs to resign...
 
So where are all those owners who just wanted this to go away?
they're upset that the pats are cheating again, stealing plans from the locker room, and messing with the headsets. The pats are so far into their delusional heads, they can't win, on the field or in court.....

Just in time for the Bills game. I think Belichick filed the appeal to rev up his team and his quarterback.
