As per the ruling, it's not 'fairness' so much as actual due process. It doesn't matter what a collective bargaining contract states, any accused person is entitled to know the charges against them, the penalties or benefits of their pleas, and full disclosure of all evidence against them. Not one of those things were in any way granted through this entire debacle. Goodell and the NFL got exactly what they deserved.

The terms are being used pretty much interchangeably. Brady was denied fundamental fairness because he was denied due process. An appeal which follows the basic tenets of due process is considered to be fundamentally fair. One that does not is not.
 
Florio just said on the PFT show that this win was a slam dunk, Gronkowski spike, "go get your shinebox" reaming on the league.

Don't think he could be much stronger on his opinion.
 
I was at work all day...got nothing accomplished..was on the comp all day and twitter....i can't wait to be there in a week...ticket prices have gone through the roof now

This wasn't a failure of due process. It was a failure of human integrity and human judgement among all of the executives of the National Football League and the 32 owners for whom they work.

The NFL owners should be ashamed of themselves, allowing Roger Goodell to act so unethically and abuse his powers. Don't these people have a sense of right and wrong?!?

Actually I think he was exonerated and Berman just couldn't rule it that way, he had to rule it on the points Kessler was arguing.

Just my opinion, but I think if Berman thought the nfl proved that Brady did it that he would have went halfway and ruled for it to be re-arbitrated with a neutral arbitrator.

So let all the mediots and idiots cling to "he wasn't exonerated" but IMO Brady was.
 
Haven't posted in a long time, as I'm a lurker at this point. I was a Tebow Boi from 2013, but became a quasi-fan of just the Patriots.

I just wanted to congratulate the Patriot fans and organization -- this was all crap from the start, and I'm in awe of how Brady never wavered, stayed calm, and fought this thing all the way.

Way to go.
 
Back to the losers who criticized Brady for not talking, not going on mountain top to proclaim innocence : you are idiots. Brady stayed tight lipped, NFL and minions were blabber-mouth weirdos. Who played it better ?

While a lot of us wanted to see Brady and the Patriots get screwed, this is actually a big win for everyone. It is, and always has, been absurd that Goodell acts as his own arbitrator and this is a first step towards rectifying that. So as much as I wanted to face JimmyG in Week 2, in the long run, this is the best result for the long term integrity of the league and the next time a player on your favorite team has to face Goodell.

That's the attitude everyone needs to be taking. The NFL discipline policy has been a joke on everything but drugs (because the punishment is built into the system already) for a long time, and is only getting worse. It's seems like every few years the NFL will draw a hard line on something and pick out a team to punish as a show of force to the rest of the league. I guess that's fine to some when it's not your team, but given enough time and power and it may well be your team someday.

They punished Brady on hearsay, circumstantial evidence, and "failure to cooperate" If my employer tried to tell me they had the right to look at my private text messages or email without a court order I would tell them to pound sand.

What do you do when you have beaten 31 other teams in the league? You step up your game and beat commissioner and the NFL.

If this was a video game, Brady just reached the final boss and won.
 
No, it's not impossible. The CA2 panel could rule that notice actually was given or that notice was not required.

I don't think its at all possible to overrule Berman on whether notice was given or not. So I guess that the notice was not required would be one way, I'd be absolutely stunned.
 
So excited about the decision this morning that it's finally starting to hit me. All the endless scenarios we discussed. Brady received the BEST possible decision. No suspension, no arbitrator, the decision was completely vacated. WOW! We won. We really won.
