No. The appeal will only take into consideration the record of the federal court case and nothing else. There won't be any new anything (other than citations to more and more and more cases :) ).
This is correct. No new evidence is introduced to the higher court; they only review the record presented to Berman.

No, it's not impossible. The CA2 panel could rule that notice actually was given or that notice was not required.
Not only did the NFL fail to give Brady notice, it also applied the wrong punishment scheme to him. They used the disciplinary procedures that are applicable to the team, team officials and head coach, rather than players. They also admitted that Brady, as a player, is not provided with a copy of the disciplinary procedures, including possible punishments, that were used against him. It is mind-blowing how f-d up this is by the NFL, considering they so desperately, obviously wanted to nail Brady and the Pats for something.

IMO, there is no way that the 2nd Circuit overturns this well-reasoned opinion.
 
The NFL has a little to no chance to win on appeal. the 2nd circuit overturns only seven of appeals brought to them and this will not be a high priority for them

Not arguing with any of that. Only saying that it is not "impossible" for Berman to be overturned. It's not like basing vacatur on lack of notice (among other things) is some bulletproof shield. CA2 could decide that in its reading of player contracts notice is given, etc. Not saying it's likely, mind you. Just not impossible.

I'm more likely to walk up to Gillette, at 185 lbs, and being granted the starting FB, than the NFL* is likely to win the appeal.
