The way to get the picks back is to get Goodell fired, and have the new Commissioner overturn the punishment.
 
Kraft has a reputation in the business community as being ruthless. As much as I currently dislike the man, I wouldn't call stupid - which he would have to be accept this insane punishment. The almost same exact thing had already happened with spygate, so he can't say he was caught off guard. Therefore, I can only conclude that his loyalties lie elsewhere, which he pretty much said during his capitulation speech. And for that I say screw him. He belongs right there with Goodell and the other pieces of **** that infest NFL ownership and league office. A couple of half-assed, measured statements of fake outrage don't get him off the hook in my book. There's a better chance of hitting the lottery than Kraft fighting for the picks back. It won't happen.

Robert Kraft would face an improbable legal fight since he accepted the punishment. But he could argue acceptance is void if he was misled.

I guess I'm an optimist, but it sure would be great if they would pursue getting the picks back, I always felt the loss of the draft picks was more harmful to the Patriots than the TB suspension.

I'm sure that it is fun to be an NFL owner, you are part of one of the world's most exclusive clubs. When he agreed with the original punishment, he showed that his club ownership was more important to him than the good of his team. However, I can't believe he anticipated the outrage that resulted from Patriots fans. It used to be that he was beloved by Patriots fans, and now that just isn't the case (I certainly haven't heard about many public appearances for him), it can't be fun to be hated by your own fans.

Maybe this would be a good way for Jonathan Kraft (who seems a bit tougher) to spread his wings a bit, with a legal fight to regain the picks. Anybody think there is any hope for that?

As happy as I am it won't happen. NFL has no legal obligation to do so.

The question is does it feel that it has a moral obligation as a matter of fairness?

Nope.

Agreed, the only way it happens is if there's a groundswell so severe that the NFL feels compelled to do it. And while I could maybe see that groundswell happening--I've heard it called for on ESPN multiple times today--I just can't imagine that the NFL cares. They're going to hold on to those penalties if for no other reason than it's all they have left.

If Kraft went to war with the NFL over this, he'd gain back a lot of the respect that he's lost from me.
 
This is a battle that probably should be fought AFTER the current season, in the months between early February and the end of April. In the present the job should be all about behind the scenes lobbying with owners.

I'm the optimist, but even I can't see that happening. That would require integrity on the part of the NFL management, and they've been in cover their butt mode for at least a year now, trying to not look stupid incompetent, and only looking more and more stupid and incompetent as the process went along. At every junction, they have doubled down. And, they have already said they are going to appeal (did they even have time to read the verdict?). I can't see the NFL restoring the picks without being forced to.

Since the are stupidly appealing the ruling, Krafty wont bother.
 
One of the big reasons the NFL is appealing is so they can justify their intransigence if Kraft does push for a return of the picks.
 
Next up Jastermski and McNally's defamation suits against the NFL. They are not public figures, both have been accused of being part of a conspiracy or worse. Berman does not even seem to buy that that tampering even took place and he didn't even get into the science. Berman uses "allegedly deflated footballs" and "seemingly under-inflated footballs". He did not buy any of it.

Jastremski and McNally, I guarantee you can get a lawyer to handle this for a cut for free. This would be the trial of a career for a young hungry great lawyer looking to make a name. It could be filed in a Federal Court in Mass.

Lets see the discovery in this action. Goodell's troubles could be far from over and he better have his texts.

Kraft needs to push those other owners buttons on speed dial and start politicking to fire this loser. Tell them how go-to-hell has opened up the flood gates for every single case to get challenged, even the slam-dunk criminals.

But a new or temporary_tagliabue-transition commish needs to be in place during the season if there is any hope to get picks back. Robert shouldn't talk about the picks though until the coup works, unless it is just to threaten roger with pursuing firing him unless he gets the picks back

Ken, I agree. And to respond to one of your earlier posts (about a TB defamation suit), I would very respectfully argue that a defamation suit by TB might not really be best for him. This legal stuff is really, really stressful. It may not seem like it to us, but it has to be for someone going through it (just as I found that the definition of a non-serious cancer was: someone else's). For someone like Brady who is so much about focusing on his game, it has to have been a complete nightmare. Now it looks like there will be an extensive appeal. Just look at Brady's face over the last few months, it clearly has taken a toll. It would not be surprising if it has taken a toll on his personal life also.

A defamation suit would be even more stressful, and of course it would open up his personal life even more than has been the case so far (although admittedly it would open up some even more embarrassing things for the NFL). Plus, he doesn't need the money, I would think the stress and wear and tear on him wouldn't be worth it.

If he files a defamation suit, I think it would be best to at least have it be after the season (as you say), and maybe several years down the road. My one-minute Google search indicated that the Statue of Limitations for a Defamation Suit is 3 years in MA.

Now, the ball guys that the NFL had fired (I'm sure the NFL was responsible), that is a different matter. They could use the money (which could easily be millions of dollars), and that would probably open up some embarrassing things for the NFL also. I hope they are speaking to an attorney right now! :D
