Actually Berman said he didn't address the notion of Goodell as an independent arbiter because the case failed on the lack of notice as well as other issues..
Does that mean those factors are still in play in an appeal? Would be hilarious if appeal upheld and even more factors used against NFL.

Thing is, after his piece on how Brady and the Pats were far apart on a contract extension and then just says later it getting done, I question if he was ever close to him.

I think early in Brady's career they were close after Silver did a piece on him for Sports Illustrated in 2001. But Brady became too big and Silver is small potatoes in the NFL media world. They probably drifted apart.
 
Seems to me that Judge Berman lied, or at least mislead us.

Didn't he say that if he was forced to rule neither side would like it?

Well we forced him to rule, and damned if I don't love the hell out of it.

Best part I heard today was Schefter saying some NFL folks saying justice was served today and maybe it was the ghost of VInce Lombardi who died 40 years ago today!!

Goodell just issued a statement that's being read on ESPN right now. The NFL will appeal, because it's super important that he maintain the authority to protect the integrity of the game.

Mark Schlereth is absolutely blasting him on maintaining this point while refusing to abide by basic legal standards of discovery. Glad someone's finally making that point, although it's ridiculous that it took this long (and today's ruling) for people like him to start exercising common sense.
They DO award attorneys fees for frivilous appeals. Brady should request the NFL to pay his if they are dumb enough to expose themselves again by appealing a pretty iron-clad decision.
 
Pulled up to work this morning when the news broke. I'll just say that this has been a great day. Would rather be at home watching and reading all the reports but I'll get to that at 4pm.
 
I haven't read the decision yet but, from what snippets I've seen, the appeal would probably end up as more of a beat down this Berman's ruling already seems to be.
You're right, Berman has basically told the NFL that he's overturning the suspension based on the listed issues, BUT they aren't the ONLY issues he could of used except it would have been redundant.

He was nice enough to give them a warning. Thank heaven Goodell must be being advised by idiots. In my view the longer Goodell keeps this in the public view, the more likely Brady and the Pats will be vindicated.

The narrative from BSPN and the NFLN is obviously still painful if you care about Brady's legacy and the Pats reputation, but it's irrevocably changed, and will be a lot easier to attack, give time to get our message across. Thankfully Roger has given us that time. ;)
 
NFL is just stupid not to let this go, I cant see them winning based on the current ruling. Nfl just stupid to continue this.

Barring some sort of judicial miracle, there's no way the NFL wins an appeal, precisely because Berman ruled so clearly on process, and the points he made were pretty unassailable. For example, Pash not being allowed to testify. Nothing can be done to undo that. That's forever a fact of this case. And it's a fundamental issue of unfairness. Nothing can be done to make that fair.

The other issues are true too. Law of the shop, notification, etc. Gonna be difficult for an appeals court to overturn this.
 
With Goodell being 0-5 with the Federal courts and being called a liar for one for them (Ray Rice), isn't it time for the narrative to refocus on questioning how or why Goodell found Brady guilty of something? Especially in light of the lack of "Independence" of the Wells/Pash investigation?
