Now is everyone happy Berman waited an extra day or two to release the decision? He needed to make sure his decision was thorough and ironclad for the inevitable appeal by the NFL
 
So, I'm just getting back from a 3+ hour doctor's appointment....

Anything new happening?

I was wondering where the hell you were. No, same old, same old. Something about a ruling in the Brady case...
 
Michael Silver is going to be taken off Brady's Christmas card list. He always wanted us to know he was in tight with "Tommy", but he is smearing him on the NFL Network right now.

Disappointing. Brady has not said a single word except that he didnt do anything and refused to settle which agreed to admitting guilt.
 
I love how at the end of his decision Judge Berman specifically makes note that he is not reaching Brady's claim that "Commissioner Goodell was 'evidently partial.'" So, even if the unlikely happens and the Second Circuit Court of Appeals overturns Berman's ruling, that does not mean that the NFL wins the case and Brady's suspension is re-imposed. Rather, the Second Circuit would remand the case to Judge Berman to determine if Goodell's award should be vacated on one of the other grounds that Berman says he didn't address. It's like Berman gave Goodell a warning shot: things could get really ugly for you Goodell if the NFL manages to get this case sent back to me.
 
Roger Cossack reduced to arguing that Article 46 does nor require Goodell to be fair and there is no fairness required in the essence of the agreement. That's sure to make the NFL look good.

This was the NFL's entire argument.

It may be ridiculous for Goodell to be the prosecutor AND the judge in this case, but that's what the CBA says he can do so tough crap.

It may be ridiculous for Goodell to be able to issue any penalty he wants for any infraction he wants, but that's what the CBA says he can do so tough crap.

It may be ridiculous for Goodell to flat-out lie about a player, but that's what the CBA says he can do so tough crap.

It may be ridiculous for Goodell to claim that an investigation is independent, backtrack on it when it's shown to clearly NOT be independent, but it doesn't really matter, because the CBA doesn't require it to be independent so tough crap.

It may be ridiculous for Goodell to punish a player for being "generally aware" of potential wrongdoing by others in the organization, but so what, the CBA allows him to do that so tough crap.

It may be ridiculous for Goodell/Wells to tell Brady they don't need his phone, and when Brady offers all kinds of electronic documentation Wells decides to not pursue that, but then when Brady doesn't turn over his phone they hit him with a penalty for that, but so what, the CBA allows him to do that so tough crap.

I mean, that's been the NFL's entire argument this whole time. Glad Berman smacked it down.
 
I know some people earlier were worried that the decision had ruled that Goodell was impartial

Of course, along with the "you know he did it, they just couldn't prove he did it" ********, ESPN said on my drive in that Berman explicitly ruled Goodell was impartial. I guess when you've been spinning as fast as they have, you need some time to wind down.

I had to bring a family member in for a doctor's appointment. I saw the news about 30 seconds after Schefter's tweet, and my first reaction was basically "@#$#@%#$%$#%$# Berman! You couldn't wait until after noon?"
