So, I read the Berman decision. I found that Berman was actually nice to the Commissioner by not confirming the following:

"Brady also argues that "prior to serving as hearing officer, the Commissioner publicly lauded the reliability of the Wells Report [which was conducted by NFL retained counsel]- the issue at the very heart of Brady's appeal." This "locked him into supporting the Wells Report and rendered him incapable of reaching a contrary conclusion in Brady's appeal, as doing so would undermine his own competency as Commissioner"

Berman showed that in court, imho..
Good point DB, but I think it would be better suited for the defamation case. ;)
 
Only problem for us is that Berman refused to comment on the NFLPA claims about the facts of the case. He never defended the Wells report, he just said that he accepted it because he had to as a consequence of arbitration. It would have been nice for him to tell the league/public that their investigation was a farce. I'm sure he didn't because it would have made the decision more vulnerable to appeal.

He couldn't. By law, he can only judge the "process" and not the underlying facts. He shot the process to hell and wrote that he didn't even consider some of Brady's other claims because he won on the earlier ones, notice etc...
 
While I'm delighted at the ruling, the overwhelming emotion is one of relief. Finally, somebody in a decision making capacity has seen through the web of lies and deceit and done the right thing. It only took 7.5 months...

So while I'm happy that TB12 plays next week, Kraft rolling over and accepting the loss of draft picks still grinds my gears beyond belief. I'd love to think that he and the team now take the NFL to court to get that overturned, but I don't see how they could.

That said, I will only be truly happy about this farce if/when the rest of the world wakes up to the FACT that Goodell and his cronies are inherently corrupt and have no interest in the integrity of the game, and as such are summarily booted out of office. I'll only start going to the games at Wembley again once they've cleaned house in New York.

So now we look forward to the NFL appealing this decision.

There seem to be several possibilities:
- NFL appeals to get the original suspension returned, and served in the future - I await legal opinions, but this seems sort of unlikely
- NFL agrees to rehear the arbitration - is this possible? What if they give Brady the notes, give Brady access to Pash - the issue still hinges on the player not being PREVIOUSLY notified of suspension for "general awareness." This seems to be a key.
- NFL drops appeal and focuses on improving player discipline process

Given that the case focused on prior notice of general awareness of likely behavior of others, it seems unlikely that the NFL can re-arbitrate and re-punish Brady.
 
I'm waiting for a take by a real lawyer on this Board, but it looks to me like he vacated primarily on Fairness and Notice, which should, in my layman's opinion, should make it hard to overturn on Appeal.

Otherwise, GOTTA LOVE IT:

For the reasons stated herein, the Management Council's motion to confirm the arbitration
award [ECF No.4] is denied and the Players Association's motion to vacate the arbitration
award [ECF No. 28] is granted.

Brady's four-game suspension is vacated, effective immediately.

The Clerk is respectfully requested to close cases 15 Civ. 5916 and 15 Civ. 5982.

I'm a real lawyer (sometimes) and the NFL is stupid if they appeal. Judge Berman even gave them a little tweak at the end of his opinion listing Brady's other good grounds for overturning the award, which Judge Berman didn't even have to get into. As a lawyer I say WTF was the NFL doing in having Wells' law firm represent them in the arbitration hearing, where they were pushing an "independent" investigation by them as the basis for Brady's suspension (and at the same time, not allowing Brady's team to interview or examine the NFL employee who edited said "independent" report)?!? LMAO - can you say conflict of interest and lack of impartiality 101? Berman absolutely hammered them on this, and rightly so. I am NOT a Harvard-trained lawyer and I say WOW. Either complete and utter arrogance or complete and utter incompetence. Goodell should be fired, TODAY.

So happy for Tom Brady that he is out of this disgusting sham, but the NFL has some serious house-cleaning to do at the top. I am STILL not watching any NFL games other than the Pats, or buying any NFL merchandise until they fix the "integrity of the game" at the top.

A real-life goat invades ESPN

BRISTOL – Despite ESPN’s extensive security, a goat slipped onto the campus of the worldwide leader in sports Thursday and took a quick tour.

Yes, a goat, horns and all.

The half-hour long chase by guards and city police lasted long enough to lead to a trail of tweets and video from the network itself.

Spokesman Mike Soltys said that aside from the ever-present geese, barnyard creatures haven’t been seen around the 17-acre Middle Street campus in the past.

The goat apparently escaped from a new owner, who had just bought it, and headed for the greener pastures of ESPN.

Let me guess . "This doesnt mean brady is innocent!" . This will be their theme today. I alreayd heard it in other radio outlets.

Well, it's true. This victory in court doesn't mean Brady is innocent. It means that the NFL was wildly unfair and led a ridiculous process that had no business taking place.

Though from his questioning and even his comments in the ruling (though he couldn't actually rule on this) it's clear that if Berman COULD have ruled on the merits of the case itself, that he would have declared Brady not guilty.
 
Obvious implications:
Huge celebration of the Super Bowl, with the banner, on opening night.
Brady's record of starting the season continues.
Those having Lindley on your projected roster are updating their Pats Picker selections.

I thought Berman was tweaking the "Harvard trained lawyers" all along...he's 71, but it doesn't mean he doesn't know how to have a little fun.
 
Michael Silver is going to be taken off Brady's Christmas card list. He always wanted us to know he was in tight with "Tommy", but he is smearing him on the NFL Network right now.
 
So, I'm just getting back from a 3+ hour doctor's appointment....

Anything new happening?

Speculation is that the Pittsburgh Steelers are "scared for their health next week." Whatever that means.
