It's Over, Judge Vacates Tom Brady's Suspension

Tom Brady has a history of being a winner, and on Thursday Judge Richard Berman granted him another victory after vacating the four-game suspension that had been imposed by the NFL for his alleged role in the DeflateGate debacle.

NFL has no chance assuming they even bother.

I will not say the NFL has no chance but the circuit court tends to like to stick with the initial ruling unless there is a very strong reason not to. I think odds right now are Brady wins the appeal 90%.
 
Judge rules no notice, therefore cannot be rearbitrated!!!!!!!!!!

The Award is premised upon several significant legal deficiencies, including (A) inadequate notice to Brady of both his potential discipline (fourgame suspension) and his alleged misconduct; (B) denial of the opportunity for Brady to examine one of two lead investigators, namely NFL Executive Vice President and General 20 Counsel JeffPash; and (C) denial of equal access to investigative files, including witness interview notes. (A) Inadequate Notice of Discipline and Misconduct (i) No Notice of Four-Game Suspension: Steroid Use Comparison The Court finds that Brady had no notice that he could receive a four-game suspension for general awareness of ball deflation by others or participation in any scheme to deflate footballs, and non-cooperation with the ensuing Investigation. Brady also had no notice that his discipline would be the equivalent of the discipline imposed upon a player who used performance enhancing drugs.

Yeah, I'm not even worried about the appeal. Brady won when the odds were stacked against him. On appeal, the odds will be stacked in his favor, and the only way this gets overturned is if the appellate court decides to ignore the existence of years of legal precedent and the Federal Arbitration Act.

This is going to stand. I said it yesterday when we were worried the judgment would go against Tom, and I'll say it a lot more happily now. I wouldn't even really worry about it. There's always a couple of activist and/or Brady-hating judges could overturn it, but compared to winning this initial case it'll be a walk in the park for Brady's team.
 
The Deflate Nonsense is finally over.
 
Hope Tom annihilates this league. Blows them all up.
