Yea and what happens if he rules in favor of the nfl. What's the excuse for the wait then?

What's your point? How is this relevant? No one is making excuses for Berman.

The judge stated he expected a ruling by Tuesday or Wednesday, and certainly no later than Friday.

Assuming he issues a ruling by Friday, he won't have been dishonest whatsoever.

No one is making excuses for him, we're pointing out that he hasn't been dishonest (as you asserted), and furthermore, that it's to be expected that he'll take his time to write a carefully worded, reasoned ruling.
 
Well..he assumes that if the judge does it and no one appeals it , it will stand. Even though the judge is technically not allowed to do that. Some weird logic.


I read somewhere that the appeals court can take the case even if neither party appeals it. Is that true and if so why Florio argue this point?

I'm sorry that he is not meeting your personal standard of professional conduct. Let's look at from another perspective. Your manager gives you a project to do and says you have until Friday, but you say you think you might be able to get it done sooner. After doing a little more work you realize you need until Friday and let your manager know. Is that unprofessional as well?

Well, if you took his words to mean "definitely, 100% Tuesday or Wednesday", that's on you. Berman made no guarantees (save for that he'd rule no later than Friday).

You seem to assume that he's intentionally dragging this out, and that he was disingenuous with regard to the timeline he laid out on Monday. I think those are unfortunate assumptions to make. Berman was likely uncertain of when, precisely, he'd rule. These things take time and it's a fluid process.

I'm not bothered by Berman at all, by all accounts he's been fair and can only hope he rules in favor of brady.

Berman just likes to troll us a little bit. He will surprise everyone and issue his order on Thursday, and proclaim "HAH! Didn't see that one coming did ya?!"

No worries. I completely agree. I'm just hoping that the delay favors Brady and Berman is writing an ironclad pro-Brady decision that cannot be overturned on appeal.
 
Regardless of ruling, I can't shake the frustration and feelings of hopelessness re : the picks, the sting, the league-wide hatred. Don't get me wrong : rather have all this BS + cheering for a winner, than be a Jacksonville fan. But still - that first rounder really gets to me.

But if he is ruling for Brady, that would be more of a reason why to take more time. It is far easier to write an appeal proof decision for the NFL because the law is on the side of the arbitrator. To uphold a decision for Brady, Berman would need to really craft sound reasoning backed by case law because it is far easier for an appellant court to fall back on the fact that the NFL has a lot of leeway on their process.

C'mon Berman, provide us with some relief! I'm beginning to wonder if he is just leaving the parties hanging to see if the NFL will cave and come to reality with a reasonable settlement offer. Making a ruling "appeal-proof" is one thing, but a settlement is about as "appeal-proof" as you can get.

I say take your time Richard. The longer he takes to write his decision, the more likely that he is ruling in Brady's favor.

Can't trust a judge who gives you a window on when to expect his ruling and then turnaround and give you it late.

If by no later than friday, he means Friday than that's exactly what he should of said. Not professional if you ask me.

You have never dealt with a court have you. Usually, if they say they will give you a decision no later than Friday, September 4th, it means you won't see a decision until February. If and when Judge Berman gives a decision by Friday, it will be one of the quickest turnarounds in Federal court history.
