Per source, the NFL and NFLPA haven't had any Brady settlement talks since Monday's hearing. At this point, last-minute deal very unlikely.
 
Either way this goes down. I'll be relieved.

This crap has lasted longer than spygate.

Compared to spygate, this is only in the 1st quarter cause of all the court stuff. I'm so tired of it that it's actually taken a toll in real life stress.

Sure, that is the pessimistic take. As a group, I think we need to understand that whatever Judge Berman decides is very unlikely to get overturned on appeal. If he rules against Brady, then realistically that's it for him. Maybe he can get an injunction and play out this season while it's appealing, but I won't have any reasonable expectation for an appeal to go his way if Berman doesn't.

But look at it the other way: if the decision goes for Brady, this is great news. For better or worse, Berman's decision is likely going to be the decision. So let's just hope for the best and let it be.
 
And I'd tend to think that this would be of the utmost importance if he ruled for Brady (vacation of the award).

Reasons being twofold:
a.) Brady is less likely to appeal (should he 'lose') given the potential of missing time later in the season.
b.) The bar was set high for Brady to begin with. Should he choose to 'appeal the appeal', the chances of him winning said appeal would be infinitesimally small.

The opposites apply should he rule against the NFL. The NFL would very likely appeal Berman's vacation, and moreover, the bar would be set lower for them (with regard to providing satisfactory evidence for an overturning of Berman's ruling).

In other words, Berman needs a particularly strong ruling should he side with Brady. The wording, legal language, etc would need to be impeccable. This would be less important should he rule in favor of the NFL.

This is why I'm inclined to read any delay at this point as being slightly favorable to Brady. A case affirming Goodell's judgment should be pretty straightforward and easy to write. If Judge Berman is taking the time to painstakingly comb through his decision and appeal-proof every last part of it... well, that doesn't mean he's ruling for Brady, but it's a step that becomes far more important if he's ruling for Brady. So if you're inclined to read anything into it at all--and granted it's probably wisest to read nothing into it--you should be more inclined to read it as good news.

Sorry, gotta call BS on the TB half of your argument. The dynamics don't change for him, he loses little by appealing again:

1 more money - he has that,
2. any appeal would undoubtedly involve an injunction on imposition which could very easily be pushed out a whole season- so I don't buy the late season part,
3. his legacy is affected by the loss of four games whenever they occur-so he will fight for that legacy
4. Disagree the bar is high-nfl lost what percent of their recent cases? 4 of 5 I think-80%.
4b. Sure the bar us high for 'general arbitration cases' -this ain't a general case. And if Berman goes against ALL FOUR SOLID LEGAL ARGUMENTS, then this thing was personality driven, and at that point take your chances with the next set of personalities at the circus court level

BOTTOM LINE: Berman has to know that whichever way he rules the losing party will UNDOUBTEDLY APPEAL.

But in my opinion, the nyjfl appeal would be a pro forma thing where they are just a dog marking their territory. do the appeal so they can go to the press /owners and say we didn't give up, he was still guilty-he just got away with it.

I believe the clerk term theory and that he is just doing due diligence on a lengthy paper (assuming the 50pg estimate is roughly accurate). He doesn't want to be made fun of over typos.
 
C'mon Berman, provide us with some relief! I'm beginning to wonder if he is just leaving the parties hanging to see if the NFL will cave and come to reality with a reasonable settlement offer. Making a ruling "appeal-proof" is one thing, but a settlement is about as "appeal-proof" as you can get.

Wholeheartedly disagree on this. He probably wants to produce the cogent and convincing decision possible and it is taking a little longer than expected. I don't think he was purposely lying...
 
Yea and what happens if he rules in favor of the nfl. What's the excuse for the wait then?

While we're on the subject and no news had filtered in, I'd like to make my disgust for jerry Thornton public.

He thinks he's so ****ing cute with his pop culture references and his fanboyism.

It really bothers me that this dude is making all that money and has no idea what he's talking about. Thanks alot felger for bringing this guy into our lives.

I'm pretty sure that Berman initially said his ruling would come by Friday, and this "if not Tuesday, definitely Wednesday" thing came from a pundit.
