Why does florio keep saying the judge could issue a 2 game suspension comprise?
Well..he assumes that if the judge does it and no one appeals it , it will stand. Even though the judge is technically not allowed to do that. Some weird logic.

He seems to be saying that since he's a judge he can do anything he pleases, but it is unlikely because there isn't precedent to cut the suspension in half and he would be overturned. Hence, there is no way a judge would ever do that knowing he would be overturned. He can't just make up his own rule of law.
 
Nor is Ordway, sadly. Why do these stations insist on recycling useless personalities? There really weren't any better options? ****, not having a 3rd person was a better option. :rolleyes:

Right. The NFL couldn't even explain to Berman how a 4-game suspension was agreed on, and on what basis could those games be attributed to either failure to cooperate or game-integrity. So why is Florio saying that Berman can reduce the suspension? Is it just because the Judge can do whatever he wants to do? :rolleyes: yeah, good luck holding that up to scrutiny

Agreed. Even if Berman can do that, the option should be worded, "Berman may do something entirely different that is unexpected though unlikely to survive appeal."

Florio being intentionally misleading.... shocking, I know!
 
While we're on the subject and no news had filtered in, I'd like to make my disgust for jerry Thornton public.

He thinks he's so ****ing cute with his pop culture references and his fanboyism.

It really bothers me that this dude is making all that money and has no idea what he's talking about. Thanks alot felger for bringing this guy into our lives.

This is crazy. The judge can only affirm or vacate the arbitration award. If one thing is clear the judge can not step into the arbitrators shoes and make the decision for him. All he can do is endorse of find defect in the arbitration.

Exactly. Florio is using the same logic as saying Berman could rule that he is siding with the NFL but Brady has to hop on one foot for 2 hours as his punishment instead of missing the games (because he's the judge and can do whatever he wants). It would be quite the breach of judicial ethics to break from precedent and make up your own rule of law.
 
Florio has be really pro NFLPA so far but now he is just milking the delay for more news and click bait. He will offer a few more scenarios about what the judge can do before the ruling comes.

I can understand the dislike for Jerry Thornton. I love the guy but he can be a bit annoying sometimes.

While I want good, intelligent discussion and even reasonable contrarian viewpoints I also do like occasional homerism and Thornton does bring that in spades.

I used to like him when he was a spark plug. Or when he'd show up on Picards show on Saturdays or a random time he might be on with lou and them guys.

But he's ruined dale and holly, I can't do 20 hours a week of the guy. I won't.

Jerry's great; funny, doesn't take himself too seriously and is a welcome change from all the blowhard downers that converge on Boston media.

BTW, what has he said to demonstrate he has no idea what he's talking about?
 
Odds are good that if Brady wins, it will likely be on multiple counts. Brady had four arguments. I will bet that he will win at least two. I think the lack of notice will be one and the fact that they were not given the Wells notes or being able to cross examine Pash as the other.
He only needs to win by at least one right? I'm sure more will help prevent an appeal but doesn't the NFL have to overcome all 4 to win?

In addition, be thankful as he is an upgrade over Pete the Meat (who I had a random beer once and is freaking howl.)

Actually after reading his exact comments, what he is saying is that only works if both sides agree to not appeal, in other words, if they settle. The sides are unwilling to settle and Florio is proposing the judge can say 'here is what you are settling for' and then everyone agrees. Its intellectually defective.

That's probably close to accurate. I would say it comes down right after Berman leaves the courthouse (so he is not hounded by reporters).
 
Just heard something on the radio that made me chuckle.....that Brady should do a cameo in the new concussion movie, especially if they uphold the suspension, kind of like a in your face to goddell and the nfl office. Lol

He acknowledged that doing that wouldn't hold up on appeal, since legally all Berman can do is affirm or vacate the award. Florio's speculating that maybe if Berman handed down a 2 game suspension, neither side would appeal.

To the contrary, I'm pretty sure both sides would appeal that (is that even possible?) since neither would be getting the only thing that really matters to them. NFL wants acknowledgement that Article 46 is all-powerful, Brady wants vindication. It's a stupid theory, and Florio really should have stopped with that line of thought the moment he arrived at "legally, the judge is not allowed to do this..." and before he somehow found his way to "...but if it maybe doesn't get appealed, who cares??"
