Today is my Birthday, so Berman give me a nice 50 pages of why brady under NO circumstances should be suspended. Also bash Goodell and his cronies a bunch too.

I agree - but I thought the same thing all of April regarding the Wells Report. :(
No...the longer that took the way worse the eventual outcome was going to be. If they concluded there was nothing to it it would have been over quickly.

Or the opposite. There was nothing to it, so they had to keep digging until they found something they could twist into it.

Right but my overall point is that it was a bad sign for us.
 
No...the longer that took the way worse the eventual outcome was going to be. If they concluded there was nothing to it it would have been over quickly.
It is tougher to prove a negative so my thought process was if Wells found a smoking gun, it would have been over quickly. If he found a text where Brady says "set the balls at 11.5, brah!" then that wraps up the whole investigation right then and there. But if they couldn't find anything substantial (which they didn't) then they would keep looking and looking for weeks/months.

Judge Berman - - take as much time as you need, buddy.
 
The NFL has officially turned in it's appeal. After much discussion, the courts will now announce the judge of the NFL's appeal.

I think that Berman is well aware of what will follow. In the case of a Brady loss he will need to rush to get an injunction to play 9/10. I believe the roster needs to be set by 9/5 for him to be able to play.
In the case of an NFL loss, they will simply appeal, and recognize that it will take months.

If Berman is going to rule against Brady, and we have every indication he understands the unfairness of this entire debacle, even if he must rule in favor of the league, he would therefore want to do it early, to give him ample time to prepare an injunction request.

So, ruling for NFL would seem to entail rushing to the ruling, while ruling for Brady need only happen by the end of the week.

Yep. Lets hope Berman actually gives a crap about Brady's situation and interest in having injunction requests expedited.
 
I am confident that Brady's suspension will be vacated. My concern is how this will be vacated.

Delay is so there is a last second chance for a settlement. that Berman was going to rule for NFL* from the start... The whole thing was trying to get a settlement, not to come to a decision based on the hearings.

I'm with you but still worried.

As far as Notice, I see all of the following defects with Notice

1) Vincent punished 100% on the Wells report. No one has ever been punished for 'general awareness' and no rule states you can be. Wells testified that his report was based upon finding a violation of the Playing rules, which do not apply to players.
2) The policy he was punished under does not apply to players.
3) There is no policy that says you can be suspended for lack of cooperation.
4) Precedent. Feeley, Minn Vs Carolina, SD. Gostkowski as well since he was not punished for not giving his phone.
5) The arbitrator justified the punishment under the steroid policy which does not state ball deflation is included, nor is there any policy that makes it equivalent.
6) Peterson case
7) There is no policy that states you must provide your personal phone when asked or that you can be suspended if you do not.
8) There is an equipment policy with clear detail of fines, and there has never been an equipment violation that received more than the minimum fine.

I'm sure there are other variations I missed, but any one of these and its all over.

You cannot compare the two. The League was out to get the Patriots and stacked the decks against them. Judge Berman doesn't have that bias. He might be restricted by the law, but he isn't led by an agenda of getting Brady at all cost like Wells was.

Since the NFL has lost control of the process, everything has gone against them from the release of the appeal transcripts that showed that Goodell just wanted to frame Brady to Judge Berman constantly slamming the NFL in court.

Prior to this going to court, the Pats never had a shot because Goodell could make up the rules as he went along. Now a truly independent third party controls the process. Judge Berman could rule for the NFL, but it won't be because of manufactured evidence, lies, and spin of the truth.

I was disappointed to find Tanger on EEI while driving to work, but in the 48 seconds or so I lasted he intimated that Berman announced he was going to rule on Friday. Did that happen? If so, why hasn't it been mentioned here? If not, what the hell was Douchewaffle talking about?
