The lawyer on CSNNE made a good point: this is going to be the case Berman will be remembered for. Whatever side he chooses he wants his ruling to be airtight; i.e. so there's as little chance as possible of his word being overturned. Interesting motive that's easy not to notice since we're so wrapped up in the actual fight.

The fact that Berman sent out a notice at like 4:30 pm basically saying "I need more time", IMO means he wanted to finish today but the darn thing is taking forever to write up the way he wants. This seems to be something that favors Brady. Can't imagine it would take long to say "Award affirmed, Article 46!"

Both of you are right to point this out about Berman. I was wrong to accuse him of trolling Pats fans.

We'll have to see how he rules.....when he rules
 
This Friday marks the beginning of labor day weekend and I'm willing to bet you the decision pops up in PACER at the last possible minute, right before the long weekend; a good amount of time for the uproar to die down, hardly something that would happen if he was going to rule for the NFL.

Can't say that I agree with the thought that a federal judge would give a damn about the potential media backlash from releasing the decision on a Friday, but interesting point nonetheless. I'm sure that will be a popular opinion amongst fans as the week progresses.

Personally, I think he was trying to tell us all a couple of weeks ago that he'd do his best to get the ruling by the requested Sept.4th (end of the week) deadline, but that it would be as he noted, "a quick turnaround." How many federal court cases begin and end within 3-4 weeks? Not many, if any.

He just saw the two parties on Monday, so the thought of giving him a few days to prepare the ruling seems very reasonable to me. The problem occurred when mediots starting leaking out stories that those "in the know" were claiming that it would come on Tuesday--just one day later. We should know better than to believe those idiots anymore.

Yes--I'd have to imagine lots of media inquiries.
 
I hope "by the end of the week" doesn't imply Thursday or Friday. I really don't think I can wait another 2-3 days.

At this point, I'd be very surprised if the ruling came out tomorrow. But hey, you never know........
 
I'm hearing from Florio on Weei that Berman can order 2 games if he wants to and would get away with it so long as no one appeals. He's on right now.
 
People don't really understand how the judicial system works. Berman is the judge, he is the final say, he can do pretty much whatever he wants. If he does something that is technically wrong, he can be challenged, and his decision appealed to the next court, but that doesn't mean he can't do it. It is important to remember that Judges are different than lawyers. Lawyers use the law to try and convince Judges to rule their way. Judges make decisions.

I'll take your word for it but this is the first time I've heard anyone throw this out as a possibility. Not Mccan not Stradley not Cossack, not Munson not anyone..Maybe they did and I just missed it.
 
Listening to the idiots on talk radio and truthfully, most of the lawyers being spoken too, who if they were any good, probably wouldn't be speaking on talk radio, is kind of funny.

Berman is the Judge, he is the final say, unless he really screws something up, in which case there is a slight chance that his decision will be over turned on appeal and sent back to him. Berman could decide today that it is a $50 fine, or no fine, or 4 days or whatever he wants. It is his decision. He is also in the spotlight. This is a very high profile case and he doesn't want to screw up, and get his decision overturned. That is an embarassment, especially in a high profile case like this.

My personal feeling is like last year when the Pats played the Colts in the playoffs. Before the game, I was pretty sure the Patriots would kill the Colts, but I wouldn't have bet $50,000 on it, because any team can win on any given Sunday. It is the same thing here, Judges make cooky and wrong decisions all the time, but usually they make the correct one.

So, to me this seems like a slam dunk for Brady. There is nothing wrong with saying that Goodell can be an arbitrator. If he is impartial on an item, why not. That doesn't mean he can act as an arbitrator when he is embroiled in the middle of the investigation. This is a conflict of interest, and is illegal in labor law. All other things flow from there. It is great to have a clause that states in the best interest of the game, but if you can't prove anything happened, how can you punish someone with that? I imagine Berman looks at these things and as any intelligent person would do, says this is obviously wrong and can't stand. So then he and his clerks spend the next couple weeks writing up reasons why that is so. Reasons strong enough so he won't have to deal with this stuff again, or be embarrassed if something is sent back to him.
 
Difference between lawyers and judges. Lawyers argue the merits of a case using laws, and try to convince judges their interpretations are correct. Judges listen to lawyers then make whatever decision they want.
 
No he isn't. It might not hold up to apeal, but he certainly can, he is the judge.

Even if so, it's a judgement without basis (since the NFL explicitly admitted no split rationale exists) or precedent (since no player has ever been suspended a single game for obstruction, let alone two), so it quite literally has zero chance of surviving when inevitably both parties appeal. Saying he "can" like saying I can go jump off the Empire State Building; unless suicide is the objective, it's not a wise thing to do.
