Or he was being sarcastic, or sending one or both a message, or who knows?
 
Either he vacates or he affirms the powers of the tyrannical dictator (nah) and Brady appeals with injunction. Either way, he plays game 1.

I agree. Even though he probably sees settlement as unlikely, he is probably thinking that some last minute pressure never hurt.

No.

He's saying thank you very much to the NFL for now allowing him to go more activist on his ruling without as much fear of appellate overturn - - he gave them every out and they didn't take it.

Right. Up until the moment the judge enters his decision they can settle. Interestingly, the decision could come out of the sky at any minute. In the federal courts it is standard for the parties to get no notice that the decision is coming. It just pops up in PACER and the attorneys get an email.

Actually, even after the decision, once the loser has appealed, they can settle, though it is a lot less likely. Obviously the ruling will change the settlement calculus, but the winner might be willing to give up something to kill off the appeal.
 
I'm prepared to settle in for what will almost surely amount to months and months until we actually know the final outcome.

In the meantime, Brady has a decent chance to play until that time occurs, whether it's due to a favorable first ruling while we wait for appeal, or asking the court for an injunction in defeat.
 
This is torture, the waiting. When the anxiety reaches a critical level, I just repeat Shannon Sharpe's favorite saying, "I won three Thooper Bows!"

I hope Berman takes his time to write a scathing view of the NFL's misconduct, unless it helps the NFL with appeal. In which case, perhaps he can offer an opinion in some other manner.
