Why is it such a big deal to you?

Not a big deal, it just seemed strange since the concern was based on a conversation that almost certainly never occurred and only has one possible outcome if it did. We have enough things to keep straight about this nonsense, no need to introduce fantasy worries. :)

3. I find the Jay Feeley appearance to be a both interesting and deviously subtle by Kessler. Feeley was unable to testify, but by his mere appearance, the media picked up on it. They rapidly tried to figure out why he was there, and quickly got to the Jets equipment tampering saga, which fortifies the impression that Goodell impossed an unfair punishment and further shows how his rulings are capricious and arbitrarily applied.

I'm being too optimistic here, but I hope Feely explains why he was there or Kessler mentions it. It would be great to hear his side of the 2009 ball tampering, especially to see if the league ever contacted him about it or if they took any steps to prevent it in the future. That is, did the league really care about PSI until January. That would be a good "leak" against the league.
 
Some Comments on the Comments, and some general comments. ;)

1. I finally got the why on the reason Mara was called in by page 6. Thanks to those who informed me.

2. Volin's comment that he thinks Brady will win, and Curran's comment that he thinks it's 50-50 only goes to show the full mendacity of these media pukes. Volin, who has carried the league's water for 7 months, wants us to believe that he finally sees the light.....with a an appeals qualifier. While Curran who has tried to see reason in several article, STILL hasn't got the balls to pick a side, and hedges his bets in a typically cynical mediot maneuver. Shame on both of them.

4. I loved the line by the surprisingly erudite Matt Chatham, that (and I paraphrase) "The hearing lasted about the same time most mediots studied the Welles report."

5. It was interesting that the Judge commented that he felt in today's hearing "both sides tried hard". It would seem clear that both sides offered SOMETHING to each other. I wonder what each side was offering. Love to have been a fly on the "cloakroom" wall.

6. I agree that Berman has made his decision and given the bare bones of it to one of his clerks to flesh out. The "day or two" that is mentioned is the time it will take for him to go over what the clerk has written and make his comments and edits. IMHO, We'll hear sometime tomorrow.

7. This day was very Shakespearean. Unfortunately it was more about "Much ado about nothing", than anything climactic, like the death scene of Romeo and Juliet.

8. It's always a good day when you get to use the word erudite in a sentence and better yet when you spell it correctly. :D


Point 3 alone deserves a triple star rating. Great take by you.
 
Jay Feeley was there as a member of the NFLPA's executive committee, not necessarily as a witness or even a symbol:

"We want to thank the court," said free-agent kicker Jay Feely, a member of the NFLPA's executive committee. "We tried our best to reach a settlement that we did not reach. But I think for us, it reinforces the desire and need for an independent arbitrator in these matters of personal conduct. But we understand Tom's position, and I think the process will work itself out."

Curran's reporting on what he sees during the courtroom proceedings, not what he thinks should happen. It's clear he can differentiate between the two. I don't know why this is cynical.
Good point. Probably an over reaction to my normal sense of rage over this whole mess.

Someone should tell Curran to be more specific with his tweets, they DO get 144 characters. ;)

That is strange. Maybe the NFLPA proposed a settlement agreement w/ the NFL and TB12 said GFY?

Has to be something generally like that -- or else it's a misspeak by Feely, or a misquote, neither of which is very unlikely. :)

Even the NFLPA underestimated Brady? This dude will be a legend of legends.

Possibly it means the NFLPA tried to see if he would accept a reduced suspension and he said absolutely not, it would be an admission of guilt.

Could be a tactic. Its negotiating 101 to bring in a fresh new negotiating team to start anew. With the NFL bringing in Mara, the NFLPA brings in Feely. Feely is positioned by the NFLPA as someone who has latitude in making a deal but needs to run it by TB12. He (we don't know how hard) gets an offer from the NFL and TB12 rejects it. On the flip-side, he also has a revised offer from the TB12 camp, presents it to the NFL and they reject it.

Nothing lost. Nothing gained. Just trying to show Berman that they are trying (kind of)

I think some NFL leaks in a few hours might confirm that.

You should have put the disclaimer first. I almost punched my monitor off the desk.
 
What does this mean ?
"Position" could mean:

1) TFB's desire to not accept any settlement which is contrary to the NFLPA's wish;
2) The actual circumstances that TFB finds himself in and why that makes a settlement impossible.

I don't think the word choice means much, to be honest.

No settlement agreement reached.

Mora (Giants) and Feeley (NFLPA) (also the kicker involved in the Jets kicking ball issue) were brought into court to help the settlement talks. This might have pissed off Mora being dragged into court.

Judge said he would offer his ruling in a day or two.

Some say they could still attempt to reach a settlement before the ruling but highly unlikely.

Sketch artist did a better job than last time but only had 5 minutes so it looks a little rushed.:)


Back to the waiting game.
