SUMMARY: In 2009, the NFL suspended a member of the New York Jets equipment staff for attempting to use "unapproved equipment to prep the K[icking] Balls" before a game against the New England Patriots. The infraction was revealed in the petition filed by the NFLPA in the Tom Brady Deflategate suspension (see page 37).

VICTIM: New England Patriots

PUNISHED? Yes

PUNISHMENT: The NFL suspended the equipment staff member, but did not investigate or discipline the Jets kicker for “general awareness” or specific involvement, even though the Jets kicker (like Tom Brady in Deflategate) was the player most likely to benefit from the behavior and, in turn, the player most likely to be aware of the conduct.

Isn't the operative CBA from 2011? Granted Goodell was the commissioner in 2009 and the offending team was the Jets.:mad:

I hope Berman insists on some explanation for the inconsistent treatment.

I'm not sure there was any material change to the relevant portions of the CBA between the previous CBA and the current CBA. That's my impression if I remember correctly.

would be a devastating blow if the judge rules for the nfl....:(would make me absolutely sick!

You've been expecting the worst since day one, and telling us about it in post after post. If that actually happens, why would it make you sick at this point?
 
Berman already said he could vacate just on the NFL refusing to let Pash be a witness so IMO he showed his hand and he can't rule anything but.
 
Honestly, at this point, everything that could go our way, hasn't, so it's tough to feel optimistic.

One would hope that a pro-labor Judge such as Berman, who's seen through the NFL's BS this entire court saga, would "do the right thing", but again, who knows....

No Brady, No Banner. Let's make opening night ugly.

I don't know why so many of you are so worried. There was noway things would have gone our way in the beginning when it was in the NFL's court. Since it's moved to a real court it's all gone our way.

Even that probably gets him more attention. I think best thing we could do is ignore him til he eventually goes away. He's like the boogie man(or was Jake Bequette?), he only exists if you believe.

Sciz, forgive me but what does this mean?
Yeah, I should add some context. Rice was "re-suspended" on September 8 after the elevator video was released. On September 10, law enforcement said they sent the elevator video to the NFL. Also on September 10, Feely criticized Goodell's role as potential arbitrator in that tweet. I guess it shows that Feely has been vocally pro-Union even in matters that don't involve his former teammate Brady or any ball stuff in 2009.
