I remember hearing this live a couple of weeks ago and just found the link:

Ok so there are two big moments around 8:40 mark when he questions why all the ESPN legal analysts are saying the NFL will win for sure and then the big one is around 10:30 mark.

If you don't want to click (I recommend to hear it exactly) I've paraphrased dialogue starting around 10:30 mark:

After finishing playing the audio of Cossack/Munson saying CBA rules etc, he says:

"Yeah and there ya go, powers vested in Goodell from the CBA, and that' how the NFL has conducted itself throughout this entire process that it cant lose and wont lose. and that's why they've been entrenched in their views and unwilling to settle, because they feel completely comfortable and confidence in its case. And again, Roger Cossack and the league maybe right, they maybe right....but if they're wrong...WHOA....WHOA..."

"Again I know there are a lot of experts, and maybe you can't equate it to football about upsets, CC in the studio there has picked some great upsets over the years, I'm just telling you, I have a lack of legal knowledge, I admit to that, I've never sat through many federal court proceedings, I admit to that, but I've sat in that courtroom, I've heard the judge's words. and I don't seem to think right now that its a deadlock synch (that NFL wins), the NFL is in a good position, it does have a lot in its favor. it does have a lot of legal precedence on its side, (pause) I've heard the words of the judge, and again it wont surprise me if that's the way he rules (that NFL wins), but I want to hear him say that before I say the NFL has won."

Announcer asks lets play hypothetical, what happens if NFL loses, what happens to Goodell's authority?

Schefter compares it to sports again about big games, if a team lose, will this coach keep his job etc and says:

"It's tough to go there in this situation I'll just say this, the NFL picked its venue and got what they wanted, they were very smart in the way they positioned itself, and essentially schemed to have this case heard in federal court in New York, NOT in Minneapolis, NOT in Massachusetts, it got the venue it wanted. It planned this out meticulously and beautifully. But if it blows up in the end...I would just think there's going to be "considerable fallout", what that is I don't know, but it means NFL has gone 0-5 on last 5 major cases involving Bounty gate, Ray Rice, Adrian Peterson, Hardy, and then this. But again, as Munson/Cossack have mentioned, the NFL is in excellent legal standing, but I just just keeps coming back to judges words, and they keep ringing in my ear, and we'll see what he determines in the end about what's right and what's wrong."

Dictators are often weakened. Usually they recover. Sometimes they fall spectacularly.
 
In the end, Goodell is a disposable mouthpiece for the owners (or ruling cabal of owners). For 44 million per year, they won't lack for volunteers to do their dirty work. The big problem is, they'll probably learn and make sure they have a more legally adept mind to rule the ship.

In other words, you're saying Goody is the owners' designated "fall guy".
 
In the end, all I read was more the ESPN directed bull ****. Adam disappointed me in that all he did was repeat the NFL case verbatim and just add a small bit of solace for those who are looking for justice. I wonder if its more just to cover his ass, as much as keep on pushing the NFL agenda.

Not that the league office never talks about whether the ball were deflated or Brady did anything. All they say now is that Goodell has the right to give out any punishment he pleases, for whatever reason he pleases, and guilt or innocence is not a factor.......AND the law is with him.

It's still incredible to me at times to realize that that is exactly what the NFL's argument is.

Wow. I know intellectually that this isn't really important to my life. But man do I hope this goes our way.
 
I find it funny that the only people who are loudly proclaiming the NFL's iron clad legal standing are ESPN mouthpieces and sports media.
But when you listen to "other" legal experts they're not so sure of the NFL's stone cold gem mint 10 lock.
The 3 people I heard on Ben domenech's podcast - some guy from AEI(?), stradley & I think Jenkins from WaPo were pretty adamant that Brady is in good position.
McCann has consistently hinted the NFL should pump its brakes...

I'm sure the NFLPA will surely be changing it's game plan in the next CBA as well. They sold themselves down the river last time.

They'd be fools not to. But, this gives the NFL* a limited time to try and get whatever it is they are looking to get done. So, let's see how it rolls from here and how Judge Berman anticipates the league's actions and the precedent it sets for future punishments (by the league).

He (Goodelll/League) should state this more firmly for 2 reasons:
  1. I'd like to see how ESPN tries to stand behind that and say it's true
  2. I want to see how Judge Berman reacts to the NFL*'s lack for caring about due process and basing punishment without sufficient evidence.
    1. As an adjunct to that, it will be interesting to see how he perceives Goodells role in playing in the judicial arena given Goodie's lack of education or even caring bout approaching the subject with the measured responsibility it is.

The NFLPA has been operating under article 46 since long before Fraudger GoodJet took aver as Commish. He's the problem, not the NFLPA. And thanks to him that may not be the case in the future.

People pay to see the players play, not to see the owners own or the commissioner commish.

Schefter has been leaking info from Team Brady for a while now (e.g., that he dominated at the appeal hearing). He has also on a number of occasions (on ESPN and off) said the league botched deflategate in a big way. Schefter is a sharp guy and a UMich alum to boot. He has been a friend throughout so I don't really know what you are talking about.
 
Isn't ironic that the two ESPN legal analysts feel the NFL have a slam dunk case while virtually every other legal expert either say Brady is definitely going to win or more likely to win.

Im tired of hearing "the nfl will win because of article 46" yet its a lie and false.

Theres a reason the nfl has lost 100percent of the time in court. Because article 46 DOESN'T give goodell absolute power. There is a cba he still has to follow and he clearly didnt
 
I'm not even close to saying I 100% have analyzed all the legal opinions ....

Yet what stands out for me is the absolute disregard for a fair arbitration process ...

So on that note I think Berman rules in favor of Brady.

You can't make up your own rules that are against government law and/or established legal fairness.
 
One of the things I am interest to see on Monday is how the court illustrator decides to draw Brady? Will she be consistent, will she "pretty him up", or will she conveniently be absent?

I don't recall, and it should be public record, but exactly who was writing her checks for doing a hatchet job on Brady. ?
