Well while i am not a lawyer i see the NFL attempting to defraud Tom Brady out of 1.88 million dollars of lawfully due income with a fraudulent prosecution for violating a rule that was never broken. Rico may be the only way to bring this out of control monster to heel.

I think only a defamation case would be the only way to show that there was an actual scheme to defraud for the purpose of defamation. THEN perhaps you could pursue some sort of criminal investigation. As of now, there's just simply not enough evidence.
Besides that, I'm not sure if suspending an employee for a month rises to the level of criminal fraud.
