There is no way that given the incredible lack of exactitude in measuring these footballs, that Goodell actually thinks Brady was deflating footballs by a tiny .2 or .3 psi

He still doesn't grasp the reality of the ideal gas law, as evidenced by:
1) proposing the idea of "let's try it out to see what happens this year"
2) not amending the guidelines to say that the 12.5-13.5 range applies to a certain temperature (say, 70-72 degrees F)

He doesn't grasp the basic concept of data variability and error, or else that 0.4 psi range in measurements would have meant something to someone other than us.

So if I had to guess, he STILL thinks that a ball at 12.5 psi is going to be 12.5 psi with any gauge you use, every time, and at every temperature. That means he's incredibly stupid, but never discount the possibility of enormous stupidity coupled with an ego that demands he never consider re-thinking ANYTHING driving a powerful person's actions

My one thought this entire process has been where is the direct evidence linking Brady to any tampering? As pointed out if the judge rules in favor of the NFL from this point going forward Rg knows he can get away with murder and things will only get worse.
 
My dream ruling would be that Judge Berman vacates the appeal ruling and assigns it to a truly independent arbitrator and forces the League to release to the court (so it goes on the record and seen by all in the public) all of Ted Well's investigation notes, communications, interview transcripts, revisions of the Exponent and Wells reports, league emails prior to the game, etc. so the world can see how they manipulated the facts to come to the conclusion.

I am still surprised that seven months later we still haven't seen the locker room video of McNally taking the footballs and no one in the media have asked to see it. Obviously, it makes the League look bad or they would have released it.
 
While a decision in favor of the NFL has bleak ramifications, it is becoming evident that a decision in Brady's favor might not be a favorable outcome for the league and football fans in general. The obvious scenario here is that the NFL appeals Berman's decision. This in turn extends the duration of the farce well into 2016. The cost to the league is minor, but to the NFLPA and Brady it is significant. Indeed the NFLPA may be limited as to which cases it can support moving forward. And there is nothing to suggest that Goodell will not continue to misunderstand the CBA, overreach his authority and increase his incompetency. The twilight years of one the NFL's greatest players will be strained by litigation and an inability to remove the stains of aspersions.
Actually, I don't think this is true. A decision to vacate is an enormous rebuke to Goodell's power and current course conduct as it applies to his tactics in handing out discipline. This plus the Doty rulings pretty much mean that he is put back in box of sorts as to his powers. I also don't think the owners will be happy to shell out tens of millions of dollars for "independent" investigations that turn into clown shows. There is no reason this investigation could not have been wrapped up a lot sooner. I think Goodell intentionally delayed the investigation, the initial ruling, the arbitration and the arbitration decision all to put pressure on Brady to cave in because the season was approaching. Instead, the other owners are at least a little pissed his clown show is a huge distraction to the league but especially to media coverage of the other teams.

There is no downside to a Brady victory to anyone except the NYJets/NFL front office which are one and the same and shiny crybaby teams like the Colts and Ravens
 
I'm curious where he's getting this from. Is Berman himself already telling the parties this is how and when he's planning to rule?
Well, clue one would be Burman's comments in open court or in chambers. Clue 2 might be comments from a Federal mediator if one is still involved in the settlement discussions. I imagine that hints are given behind closed doors.

That's just another idiotic remark that makes me want to set my hair on fire (btw- that's a metaphor since most of the time I shave my head. ;) ) Not even Berman can expect Brady to "settle" when a preponderance of the evidence explicitly states that he never did anything wrong, because NOTHING wrong was done in the first place. Not only that a preponderance of the evidence shows that the league office's arrogance and incompetence has left the Judge with more than enough technical legal points to allow him to overturn what should have been (in capable hands) un-overturnable .

Why would they expect Brady would ever do that?
I'm surprised at the continual apparent interest in forcing a settlement. I haven't seen how one is possible for a long time. For Brady it would be forever tarnishing his own reputation and also the entire run of the Patriots in the Brady era. Also, Brady swore under oath that he had no awareness of any scheme to deflate footballs and that as far as he knows it never ever happened. To accept a settlement without the league conceding that there is no evidence of any sort that Brady cheated in any way is not in his interest. the NFLPA, doesn't want a settlement that would concede that Goodell has the power to act as he has in this case. Phony "independent" investigation, withholding evidence, preventing relevant witnesses form testifying at arbitrations, penalties for infractions without notice, using the "integrity of the game" as a lynchpin phrase to mean whatever the commissioner wants it to mean, penalties far out of proportion to anything ever handed down to any player in the past, etc. No a settlement by the Brady/NFLPA concedes a lot of that. and on the side of the NFL, Goodell is a power hungry commissioner who has not really cared about the facts of this case from day one. If he accepted a settlement along the lines of what Brady would take he would essentially be conceding that he wasted 5-10 million of the league's money on a quixotic quest for taking down the star QB in the league.

Time for Berman to lay down the law one way or the other.

I think the 'best' case you can make about Goodell is that he realizes that they ****ed up everything relating to the actual science behind Deflategate, but he knows that if he stays on message the public will generally remain pretty stupid on the issue as well.

As long as he acts like it's not a fatal flaw to his argument, there are plenty of people--in the media and elsewhere--who will be happy to write off the IGL as 'some meaningless, hypothetical theory' while continuing to maintain that Brady probably did something.

I think Goodell's counting on people like that not educating themselves at all, and part of that is he doesn't want to validate the existence of the IGL by acknowledging it, explicitly or implicitly. It's a dangerous act, since he'll look even dumber if the public comes around, but so far there's been little sign of that tide turning.
 
This case will get settled on sept 3rd.
Not "settled" ,adjudicated. That's an important distinction. btw- Hopefully this part of the national nightmare will end on the 31st.
 
Both sides would rather lose outright than settle. This goes to Berman.

If Brady loses he can still claim his innocence but point out that the facts unfortunately cannot be corrected in this effed up system, while if the NFL loses they can still claim that "we did all we tried and we still disagree".
 
A layman's opinion here.

I have to believe that it is crystal clear to judge Berman that Roger has abused his authority given to him.

Roger has mischaracterized Brady's testimony during the appeal and lied during the Ray Rice trial. Judge Berman is aware of this and I have to think this has some influence in his thought process.

I understand that this could go either way but Judge Berman has to see that if rules in favor of the NFL that it would set a precedence that would basically remove any ability for a player to reasonably defend himself in the future.

If Judge Berman vacates this award (the suspension) the NFL would be put in the position of renegotiating for controls during the next CBA meetings. Doesn't that seem like the logical way to go? Stop the abuse of power and allow both parties to renegotiate the controls within the CBA.

Judge Berman knows that Roger is abusing his power and must think that if he rules in favor of the NFL it will effectively solidify Roger's totalitarian control if not make it worse.

Judge Berman has already alluded to that he has reason(s) to vacate the award. He has also alluded to that something stinks on the NFL side. Why would he set a dangerous precedence that would give Roger more power or control?

You have to remember that this ruling will not only serve as case law for the nfl, but also for any other employee/employer relationship governed by a cba.
So let's change the the parties up a little, for a view on the real world impact (as I understand, again, IANAL. Also, don't let the poor comedic attempts detract from the main point). Tim Brady is a automotive factory worker at Ford. He also drives a Ford truck, and recently purchased and installed some chrome (factory option) accents for his truck. Manager Kensil (after a long sunday at the strip club) saw said accents, and immediately assumed Tim, a 15 year employee with an impeccable record, stole said accents. Mgr kensil can barely afford to put gas in his yugo, so how could Tim afford such a nice truck and upgrades? He immediately reports Tim to management, and tells Tim he is "in big ****ing trouble," as he walks in from his Monday lunch, the usual 15 minutes early. Plant manager Roger Goodumbass sees the report Tuesday, and immediately launches an investigation to see if any products are missing. After a few months, the investigator, Ted Pedostache, concludes that while no product matching the description of Tim's upgrades seem to be missing, it is more probable than not that Tim can't afford said parts, and was generally aware of the custodian stealing and installing them for him.

Unfortunately, Tim paid cash for the parts, and did not feel the necessity to save the receipts or packaging. Goodumbass agrees with the Pedostache's findings, and terminates Tim's employment. Tim of course appeals, and hands over copies of his finances, which show a cash withdrawal for approximately the same amount as the cost of the parts, about a day before his claimed purchase date. Goodumbass ignores these facts, and claims that it is unreasonable for Ford to dissect Tim's finances, and issues a ruling upholding the termination, while claiming Tim was "clearly leading a scheme to steal products from Ford for personal financial gain."

There is no way Berman could morally accept a corporation having such unchecked and unbridled power to viciously defame, and ruin it's employees with zero evidence. At least that's what I keep telling myself. Here's a shot to Goodell going down, again, in court.

NFL wins Monday morning Brady is suspended four games.Goodell
having won and because the kindness of his heart:rolleyes: drops the suspension
to one game(keeps the Rooney's happy and gives Pitt.a fighting chance)
Brady returns the 2nd week making the Networks happy.

This would be a big win win situation for Goodell & the NFL.

Excuse me while I head to the shower to scrub my skin raw.:(
 
The only way that Brady can establish his innocence is if Berman vacates the Appeal. Even if the NFL appeals the verdict, Bermans actions legitimizes and gives legal standing to a Libel suit by Brady against various NFL Front Office personnel. This is the only way to force Discovery and a discussion of the Guilt or Innocence on the merits of the case.

It serves to restrain Goodell until his term is up and the owners can choose to replace him with a Rozelle, or Tagliabue more judicial and successful type of Commissioner.

If that were anything of a possibility, why wouldn't they just settle now? Even if they couldn't come to exact terms due to one side or the other not wanting to accept a game, we'd have likely heard something about the fact that they were much closer than ever before.

One thing's for sure--there's no way that the NFL wins and then suddenly reduces it 75 percent out of the kindness of their hearts.
 
I'm just saying I'll be extremely disappointed if Judge Berman rules in favor of a corporation that tries and conducts itself like North Korea.

The suit and ties of the NFL are disgusting. This as been a farce from the get go.

"In any event , the NFLPA waived this argument by not seeking at the hearing reconsideration of my decision denying its motion to compel Mr Pash's testimony"

Does this water down the Pash argument in front of the judge ?
