As Steph Stradley says, NFL banking on the uniqueness of the CBA where goodell can be arbitrator as well as punisher being the difference ,however convuluting and fd up it sounds.. Dont know how the judge see this.

Yes, but even the NFL's attempts to differentiate itself fall flat. It's committed all of the same errors that it's claiming are unique to those other cases.
 
If Article 46 were as sweeping as the NFL claims, there would be no point in negotiating the rest of the CBA.

I'm not a Lawyer, but in reading the Submission, its wording suggests to me that they have decided to go "all in" on the unique nature of Goodell's authority under the CBA (thus the comparison to a "neutral arbiter").

That further suggests that someone (Goodell? Nash? Pash? Wells? All of the above?) may have panicked over the weekend and decided that they had to make this point very clearly, even at the risk of annoying a Federal Judge when they know full well that Federal Judges are very prickly about deadlines that they have set for their Court.

Maybe they sense that Berman doesn't want to set precedent for other CBAs, and are trying to give him an out where he can rule for them without establishing non-NFL precedent? Even if so, gotta figure if the NFL wins here every CBA negotiated from here on out will contain basically the same provision, under the threat of a prolonged work stoppage.

Any provision that can be inserted into a CBA that would make arbitration an utter sham would be priority #1 for ownership, I'd think.

I think its the galaxy now. I wonder if they are building a super weapon that is powerful enough to destroy an entire planet.
