Not her best work, when she starts ramble my about how OSHA and the DEA will wrap us in their loving arms and keep the bad men away she loses me

She refers to each agency, but the meaning behind it isn't close to what you came away with.

Steph Stradley had this to say the other day when I messaged her on her blog:

Awesome post, thanks for sharing it. I do love her. She almost makes me want to give up my hardened pessimism about this case...

Well, just keep sticking your hand in the sand then. We'll let you know what it's time to come up.

Folks it is not that easy to read a judge's intentions from his line of questioning!

Fingers crossed that she is right, though.....Expect Berman to uphold suspension, but hope he does not. That's my steady state.

My favorite part;

“I don’t know what Judge Berman’s stylistic preferences are but if I went to law school, got awesome grades, worked worked worked, went through the process to get named as a federal court judge, decided many actually important cases, and then was asked to make a decision in a case that should have been settled that is this profoundly dumb, I would torch the NFL in flames that would make hades look like a refrigerator.”

This was my contention. Berman may actually take an approach of citing MULTIPLE ways in which the ruling needs to be vacated to further protect him from being overturned (i.e. making a narrowly based decision could leave him more vulnerable)

I guess the question becomes on whether Berman will offer additional commentary to chastize the NFL for conducting their "fair and impartial" powers in this way and seek to address an arrogantly flawed system to prevent each and every case from coming to the courts as it has thus far

Goodell and the owners have become the Washington Generals of NFLPA disputes and that looks unlikely to change now

Why is Berman still trying to help the NFL by having them settle?He chewed out the NFL for not letting Pash be cross examined(this alone
is reason to vacate)his words.Is he trying to avoid all the paperwork
that he has coming his way?

Not so much the paper work - but every judge will try to get the sides to settle be it in divorce or at this level.
It ends the process and stops the courts from needlessly being clogged.
