Berman’s tenor the past two weeks has been repeatedly dismissed as just an effort to move the NFL off its powerful spot. But watching Berman’s exasperation with the NFL the past two Wednesdays, it hasn’t looked like a ploy.

He seems amazed they put this dog-and-pony show in his inbox, aghast at the leaps the investigation made and irked by the lack of fairness.

This is a very, very interesting take from someone who was in the room.

Keeping with my axiom of "Be pessimistic" I still largely think he will say his hands are legally tied, that he has to uphold the suspension, even though he tried as hard as he could to push the NFL into a reasonable direction and point out how unjust the situation is.

I hope I'm wrong.

Iam a little surprised that this quote hasnt hit the big news yet.

I have no idea whether you are right or wrong, but I do know that there are times when "justice" and "the law" are on opposite sides.

If you consider Judge Berman's background, he is a man consumed with the pursuit of "justice." How many Federal Judges get an MSW and then go to Stockholm to study International Law? Not many. He is not cut from the usual mold of a Federal Judge; while he did work in the private sector for a while, he is not the typical corporate attorney with political connections who gets awarded a highly coveted seat on the Federal Bench in one of the country's two most prestigious Districts by the President of the United States..

So, he's either getting ready to vacate Goodell's ruling or he's trying to shame/scare the NFL into settling with Brady because he knows that the law and the absurd CBA might require that he uphold it.

I'd have to be a mind reader to know which of those is the case. But, what I do know is that, even if the NFL prevails on a narrow point of law, Brady couldn't have gotten a better or fairer hearing than he's getting from Judge Berman.
 
My guess is the the Patriots perhaps NFLPA are feeding Curran the same way ESPN and other media outfits are being fed by the NFL.

Except the worst case scenario you describe is still a win. It definitely isn't the full win that Brady and we all want, however, if a judge point blank states in his ruling that the NFL acted unjustly/badly, this is huge in itself. It validates Brady, the Patriots, us and every media person like Steph (as we as there are) that the whole thing was a slimy con job. A true neutral third party that is outside of the NFL sphere of influence looked at it all and called the NFL to the mat for being slimy.
Again it isn't the win I or others want but it is a vindication in itself. It is Brady's, the Patriots, our tangible vindication response to every BS piece that the ESPNs and dumbasses out there. And it will make it fade sooner....

Maybe but curran was in the court room. There is not much to feed regarding NFL's stupidity. Its quite obvious.

Not to worry, Neuro, I think you are. ;). The PA has given the Judge more than enough ammo to sink the NFL, even if he chooses to rule on this case from narrow grounds of CBA procedure. The fact that Berman has seemed to have expanded the focus to include general fairness, and the poor science and reporting behind the initial claim of tampering only encourages me more.

One of the more impactful comments from Wetzel's article was when he lambasted the League's lawyer when he fell back on section 46, telling him (paraphrase) that just because the league has a management friendly clause in their CBA, doesn't allow them to over turn basic principles of US labor law. :eek:
 
No matter how many times the court system – or even former commissioners – tell Goodell and his attorneys to go get their f****** shinebox, these guys return with the same level of arrogance, the same level of surety that they can do what they want and are the smartest guys in America.

The NFL isn’t popular and successful because of you, you nitwits. It’s the game.

Feeding him what? He is writing about his opinion of what he observed in court.
He is not reporting a rumor that someone leaked to him.

For example: Roger stated that Brady testified that he only spoke about football in the numerous "suspicious" communications with JJ. But in fact Brady testified that he did discuss deflategate with JJ.

I think it matters a lot. Goodell the arbitrator essentially stepped in for Goodell the punisher and covered his tracks. That is no bueno.
 
Assuming the verdict doesn't go to the NFL, what do you think Berman will say about his observations on the NFL and their process? I'm thinking it's going to leave a mushroom cloud over the NFL.

Though, the NFL will just try to dismiss it and carry on the fight.

I hope he questions Goodell.
I think he would make him look like a fool.

I hope he questions Brady too, because Brady will come off looking great, and then Berman can make credibility comments in his ruling.
