If no decision is reached, Brady would be suspended for the 9/10 game.
FWI In order to play, he would have to file for an injunction. Having an injunction granted is not automatic.

Certainly not automatic, but based on how it has gone in Judge Berman's court thus far it is very likely.
 
"league sources" have really reached the bottom of the barrel if this is the best they have left in their quiver.

"OK!, People, Us Magazine and The Boston Phoenix have all cited NFL sources that Tom and Gisele are heading for a divorce.".

That's the level of credibility an NFL source has with me.

This has been a fact in the case from the day the league suspended Brady. Everyone should have known it for months. It's ANOTHER example of the NFL trying to make it look like Brady better start backpedalling because his position is bleak. I mean it could cause the Pats some roster issues that BB probably can't figure out. :rolleyes:

Meanwhile, this story will probably lead Sports Center, where in reality they might just as well lead with, "Today is Wednesday, and if the world doesn't stop turning on its axis, Sunday will be coming up after 3 more days......BE PREPARED for Sunday."
 
The parties agreed not to seek an injunction in exchange for seeking expedited relief from Judge Berman.

I doubt the agreement precludes them from seeking an injunction if Berman's work doesn't conclude fast enough to suit them. Rather, I imagine it was an agreement not to immediately seek an injunction, so that Berman didn't have to deal with an injunction request and instead could get right to work on the meat of the case.
 
Yes, more or less. To get an injunction, a party has to show that it could suffer some form of irreparable harm (e.g., loss of salary and inability to play in games). So basically, Brady's suspension would be put on pause, pending a decision.

Loss of salary is not irreparable harm; it can be repaired by a monetary award.

Not playing in the games is, however, irreparable.

The two tests are irreparable harm and likelihood of prevailing. The first is so obvious I doubt even Nash or Pash would dispute it. The second is known only to the judge.

U.S District Court Judge Richard M. Berman said Wednesday during a hearing on Brady's appeal, that barring a settlement, he hopes to rule by Sept. 4, but that is a quick turnaround for him. Both the NFL and NFLPA have asked the judge to rule by that date, which is six days before the Patriots' season-opener against the Steelers. This means that it's possible that as of Sept. 5, Brady will be barred from entering Gillette Stadium if his case is not decided.

Did this turd really just say an unnamed nfl source said his suspension will begin September 4th without saying Brady will filed for an injunction which if approved would allow him to play. This is just hilarious. These guys are unreal

Eh, I think Schefter is one of the most reliable and informative guys out there. He's reporting what a league source told him but we don't know the context. He could have simply asked "What happens if this keeps going as things stand?" and the person could have gone "Well, as things stand he's suspended" without providing additional subtext.

I think Schefter is absolutely correct to report what a league source says about how they'll handle this trial and that doesn't make him a pawn.
 
The fact that the nfl* had to run to bspn to remind people about when Brady's suspension will start says to me they are just completely out of stuff to put out there and now they are resorting to the "Oh ya? Well, Brady is still suspended come September 5th if there is no ruling".

I'm still giving him the benefit of the doubt and think ESPN might be forcing the sources through him. I'm sure all this gets talked about between NFL and ESPN execs and they find out who to use to start the misinformation campaign.

While Berman hasn't guaranteed a decision by September 4, he did strongly suggest that he would have one by then. IMHO, if he doesn't have an actual verdict by that date, he will nevertheless know what his ruling will be and is simply in the process of dotting all the legal i's and crossing all the legal t's.

Given the above, I imagine he would based his decision on the injunction on how he knows he will be ruling once the final papers are filled.

Well, this time the "NFL source" is 100% correct -- as far as he goes. If Brady is unable to get Berman to grant a temporary injunction pending Berman's decision what the "NFL source" says is exactly what will happen.

Im sure Berman will give his ruling by then, then Brady will either be exonerated or will have filed an emergency injunction by then. Its more of the RG putting out more PR crap than anything.

This is ridiculous. Didn't Berman say today he'll rule by Sept 4?
