I would love for the judge to understand this all started because the Ravens accused the Pats of stealing their prepped K Ball then understand an NFL guy was stealing and selling them and was caught stealing another one at the Colts game. Ravens never said PSI. Ravens blamed Pats for NFL guy who has a history of ball theft.
 
With how the judge is signaling his conclusion to the NFL, it would be a big laugh if he ruled unequivocally against the NFL. I know many will believe he's just encouraging a settlement, but still. Can they take a hint?

Berman argued to Nash after the NFL explained why it failed to allow Brady to question certain witnesses, notably general counsel Jeff Pash, who also co-wrote the disputed Ted Wells report about deflated footballs.

When Nash tried to argue that Pash wasn't that involved and was more of an editor, Berman, like this was a cross-examination, pointed to an NFL press release that referred to Pash as "co-lead." Nash, stepped back from that lectern, again tried to minimize it as just a press release.

"Well," Berman said, "it's not my press release. You all wrote it."
Yes! Yes! Yes! Yes! Yes!

That is the big one. The question is, of course: what is that "basic process of fairness" in Berman's mind? But, once that door has been opened, I can't see how the NFL* has a hope. Brady didn't have a chance to see and challenge the evidence presented against him, time and again.
 
I will believe it when the ruling happens. It may very well be the case that he believes the whole investigation is sham and doesnt want to rule in favor of the NFL but might have to because of CBA so is pushing them for settlement .

Could be, but he'd be disagreeing with a number of other recent rulings if that's indeed his view.
 
Well If the NFLs only option is settle with 0 games with only a minor fine then it may as well roll the dice on a ruling and hope to appeal it to a higher judge though i doubt any of the higher courts would waste their time with deflated footballs.

Like Stradley said earlier this case is profoundly dumb. I don't want to come off as someone who is comparing this case to murder or other such heinous crimes. But I will anyway. If a murderer was found guilty of killing someone, in the appeal, the next judge found out a person of interest, who he feels was utter of importance to the defense to cross examine and was denied such a right by the prosecution, the case would be overturned and there is a good chance the defendant would walk free.

This whole being denied the right to interview Pash is a huge sticking point it seems.

Can anyone really believe its taken all this time for one person to finally look at this sensibly and realise its all a load of rubbish and has been from the start? How can nobody at the NFL not realised how silly and unfounded it all is.
The NFL meetings now must look like Hitler in the bunker in the final days of the war. Pretending that non-existent armies or secret weapons were going to save them from the Russian Army. We saw how that worked out.

NFL made another error. All they had to do from the start besides being honest from the get go was come out and publicly say this was a sting. Admit that this wasn't a independent investigation and be the bully everyone knows they are. Instead they sought public support and now it's coming back to bite them. Then it wouldn't of mattered if Pash edited the report or not. Haha, serves them right for framing them in the first place.

When Berman asked Kessler to read Brady's testimony aloud, NFL legal team was collectively looking like, "This can't be happening."

NFL erred in filing in NY not just because they got the wrong judge; by filing 1st, they also lost ability to argue it isn't govt's business


Pash is the one calling the legal shots at the NFL office. it was his decision to file 1st in NY.
 
Those are 2 separate grounds for vacating the award. If Berman accepts at least those 2 grounds, strengthens his decision.
He doesn't even need two grounds, he just needs one.

The more the better to increase the odds the appellate court can find a vacatur argument it can agree with.
