Again, can't read too much into strident questioning of NFL. Berman's goal is settlement, does not want to rule. Added a court date (8/31).

So Berman is aggressively attacking the intransigent party?
 
In actuality they don't want Pats winning SB again .

I agree with the point Stephen Brown made, that Berman may have tipped his hand a bit to push the NFL towards settling this. He clearly has serious problems with both the Wells Report and Goodell's conclusions. From what I have read, he even went into the process more this time - Pash not testifying, etc. So this is all very good for Brady and the NFLPA. However, and I don't mean to put a damper on things as I am extremely positive after today's hearing about Brady's case, but it could be that Judge Berman really thinks that the NFL's settlement offers have not been made in good faith and that the NFL simply seeks too much right now. But really crushing their attorney in court today, he could be sending a message that they need to get more realistic, without actually having decided how he is going to rule yet.

The biggest positive I took away from today is not Judge Berman again calling into question the "facts" (or lack thereof) underlying Brady's punishment, but rather, Judge Berman diving more into how the NFL screwed up the process. Because this is what the decision is ultimately going to come down to.

Berman seems concerned that the process did not allow the facts to come to light.
 
I think/hope that the judge's line of questioning is essentially dropping hints and leaving bread crumbs for the league to follow to move on their settlement demands. Whether the league is smart enough to pick up on it or just too pig headed remains to be seen....They ( schmucks at 345 PArk Av)are used to getting their way and may be too obstinate to move in their demands despite getting slapped by Federal judges in the past...repeatedly..
I think your right about the judge dropping hints to the nfl to settle, but we must remember goody, pash, etc. are all former jest. Thats means they're not the sharpest knives in the draw.

Even if it is a false leak, it's a pointless one, because settlement offers will be moot once Berman will rules on the issue.
If you're falling down a cliff and the only thing to grab onto is a clump of grass that you know won't hold you, you grab onto it anyway.

That has already happened. See Brandt and Hubbach. No matter how the hearing went, they would argue it's bad for Brady.
 
They should just change his title to Emperor and get it over with.

I still cannot believe that this limp **** gets paid 44 MILLION dollars a year. Hopefully this ends soon.

I think that Berman is not allowed to dispute the evidence or Goodell's interpretations of the evidence. So (for example) if Goodell says science doesn't show Brady didn't deflate or even that there's little evidence deflation happened at all, Berman cannot substitute his opinion for Goodell's.

However, I think that Berman is allowed to consider the quality of the evidence and Goodell's interpretations of it for purposes of deciding if Goodell is acting in a sufficiently arbitrary, unfair, biased way.

But I (like many of us, I'm sure!) would love to hear from someone with legal experience re: the Federal Arbitration Act about where the lines are between a judge incorrectly reopening issues of fact and analyzing fairness of process.
 
So the NFL was generous not giving Brady 8 games ! 4+ 4 psi and non coop . In actuality they don't want Pats winning SB again .

You know, I just watched "Three Games to Glory" and it reminded me of just how bad the officiating in that Ravens game was. Clearly the league did not want the Pats to get another Lombardi. Step 1 was egregiously lopsided officiating in the Divisional Game. Step 2 was the sting and resulting distraction of Defamegate.

Suck it, league office.
 
I disagree. I think he thinks the science is so irrelevant and what happened here wasn't really a thing - that it doesn't matter about the science.

Not only that, he's not supposed to be re-litigating the case.
Berman isn't ruling on whether balls were deflated but rather on the hearing to appeal the penalty for 'more probably than not being at least generally aware'.
 
If am Brady now, I am not settling for anything less than a complete exoneration and Goodell kissing his arse on the 50 yard line on opening night.

My offer is nothing.
