Deflategate Legal Time Capsule: Judge Berman Speaks

I know that Judge Berman excused Brady and Goodell from appearing in court on Wednesday, but do you think he will stay in WV. Many lawyers, Florio included, always recommends their clients appear for ALL court dates. Goodell could show up and make Brady look "arrogant" for not showing.

One would have to assume that Kessler etc were very clear in the fact that Berman cleared Brady, especially with the important joint practices occurring with the Saints.

I do not expect Tom Brady to miss those practices this week. I think Florio is just being Florio, which is fine since he has experience in these matters. That said, I don't think he knows the ins and outs of what went on in the discussions.

I hope Brady shows up in NYC tomorrow.. sometimes it is about the optics.

I hope he does as well, but he and Belichick really take these joint practices very seriously, and for good reason. I'm betting that he'll be at practice come tomorrow.

What is right and what is wrong in this parallel universe of the NFL????

Goodell does not have much to do, as he and Kensil have an appointment at the "Korean Health Spa" for full body massages, which can be cancelled without penalty..

I wouldn't worry about it, Ken. If the Judge is confident the attorneys have the authority to settle (and he likely does know that answer after the last round), then he likely would not need the parties at the hearing. This proceeding is more akin to an appeal (simple oral argument), and you rarely see non-attorneys at those hearings unless they want to watch the argument. If the Judge excused them, then it likely was not a test of their commitment to the cause.

I have never seen a federal judge concerned about attendance, unless he/she ordered the party to be in court and the party was a no-show.

I'm sure the expectations for this were set during the many hours in Berman's office. Not like Brady's behavior is going to surprise him at this point. He knows Brady pretty well by now.

I disagree because at this point...F the optics. F the haters. Just do what you need to improve. which means participate in joint practice.

It's in a judges hands, I trust Kessler to have felt out the situation appropriately so he will get a good feel for whether Brady should come or not, and advise him accordingly.

People who propose that Berman told them not to come, and to STAY AT THEIR JOBS, is trying some svengali act of tricking them into showing him they do not care about the case, are simply people who feel like saying something, have nothing to actually say, and make one up.
I call it Volinization.

I disagree with your disagreement.

If it's important to Brady, then he should let the judge know. Even better if Goodell doesn't show up and Brady is there. Plus, I'm sure Kessler has a better idea of what is going on and is guiding Brady to do what is best for his case.

Love how she features one of the times she smacked MCI around in her blog...

How could the judge possibly not think it is important to Brady?

First thanks for the post, good info here. This isn't directed at you OP.

My god, I'm so sick of this BS. This is going to drag on, and on, and on. The last thing this team needs when trying to defend a title, especially after losing so many key pieces, is this absolute foolishness.

This whole thing is really beginning to appear like a microcosm of the worst parts of this society at this point. Up is down, heads is tails, truth comes from those with the most money and their cronies shouting the loudest. Forget about actually justice.

Makes me want to vomit. There was a Monday night game on last night. Really wanted to turn it on, really did. I didn't, and I won't. Ever again, if it doesn't have Tom Brady or Bill Belichick involved.

By not showing up?

You and I (all of us here) realize how important practice might be, because we live and breathe the sport. Not sure what Judge Berman believes. Berman might think practice is not significant (to miss) for a single day or two (in the grand plan of a season of football).
