In the blog post, although she doesn't mention him by name specifically, though she quotes him, she appears to be tearing the MCI a new one:

It's worth noting that sometimes when people seem to hold irrational positions not supported by reported evidence, they are relying on unreported/unreportable information to inform their views.

  1. It's worth noting that sometimes when people seem to hold irrational positions not supported by reported evidence, they are relying on unreported/unreportable information to inform their views.
  2. It is one thing to hold such opinions. It is another to broadcast them publicly, particularly if they are disparaging. And it is an entirely different thing all together to take financial and career-altering actions against someone based on undisclosed evidence of an untested nature.
  3. Whatever the league view is of Tom Brady and the Patriots, the NFL shouldn't be making their decisions based on gossip. Or even floating the idea that there maybe, kinda, could be more info out there. Get that noise out of here
some snapshot this and send to volin.

She rather you not:

"I’m highlighting my guidelines as um, fair notice, as some of the topics in this blog post may make some want to attack media members"

Probably doesn't want to get into a stupid argument. No one wins when you argue with a fool.

ohhhh....is this what she's been talking about?
I've seen her ask a couple times that ppl don't use her words to berate media members --- had no idea what she would've been talking about.
is that you guys quoting her to badger volin?

just use your own words to call him a ****, or w/e --- no need to borrow her reasonable stuff that she put all that time into.
that effort was for edification, not emasculation.

calling out the NFL too :)

Lot of cowards on both sides. Saw more cheap hit from behind shots when players weren't looking. That one player running full on ready to strike a cheap shot, only to have the intended target turn around at the last second to stop the guy in his tracks really looks cowardly.

Legal deference standard favors NFL. However, oft settleable cases settle b4 ruling. This dumb case should settle.

@StephStradley Berman's courtupheld 66of68 arb cases from 2005-11, why would this one be different

NFL's position is all or nothing. NFLPA has various reasons to vacate. Everything depends on what resonates w/Berman

@StephStradley How many of those 68 cases were arbitrated by a neutral arbitrator, rather than the person who made the initial decision?

The Owners may hire a Commissioner to be a Pinyata take the barbs that could be directed at them. But that does not mean he has to be visiible. Rozelle and Tagliabue were successful Cmmissioners but not visible all the time.

A good and successful Commissioner should be seen but not heard. He should be respected and trusted by all. Goodell has failed in these considerations.

He may not be fired out right but I wouldn't give a plug nickel for his chances to be re-appointed.

Berman 1 clearly embarrassing NFL 2 wants settlement bc ruling=appeal delay=bad result for all 3 could rule for/agst

Stephanie Stradley added,

GamerHal @GamerhalG
Thoughts on possibility that judge Berman is embarrassing the NFL bc they're wrong but will rule that he can't override arbitrator?

I have to say this is REALLY good -- especially Steph's second response. Concise and to the point.

What's even better is in the comments section where a girl is trying to rip Stradley apart and then Steph responds in the comments!

As to the comments, Steph's money quote...

"Yes, the CBA has long granted the NFL commissioner broad powers, but they aren't infinite otherwise you would just have one rule in the CBA which would be, "The Commissioner is a honey badger and he can do whatever he wants, without regard to labor law or any arbital process at all."

Hard to predict judges. And specialized law in area doesn't 100% dictate one result. NFL has nothing real at risk.

@StephStradley who would you say has the upper hand...NFLPA or League

Maybe that's how judge feels. Maybe not. Lots of unfair things in the world that have no legal recourse.

@StephStradley how could judge rule for NFL when he has already effectively said the process was not fair due to Pash alone?
