McCann thinks this is total war

I was pretty sure that the time for settlement was past when I found out that Goodell opened all of the Owners Meetings during his tenure by uttering: "amans patriae delenda est".

We know how that worked for Carthage ;)

Cathargo delenda est

Here's hoping that Goodell and his thug monkeys enjoy similar hospitality from Gaius Brady and his legions.

Actually, the Carthago delenda est line was spoken (repeatedly) by Cato the elder, a Roman. So with Cato being Goodell and us being Carthage, and Carthage being destroyed and sowed with salt.... I'm thinking this was cool until your last line implying we're fu(ked.

I'm overmatched here. I know what "Carthago delenda est" means, and I assume "patriae" is something like "fatherland", but that's as far as I get.

Haven't you heard about the army of salt trucks that Kessler has arranged to surround Goodell's palace? I hear that their engines are kept running ;)

I was comparing Cato's obsession with Carthage with Goodell's obsession with the Patriots, but Hopefully the end result will be different in this case. How can anyone that incompetent win in the end? ;)

He thinks it is all out war? Huh, really?
Look I like and respect McCann a lot and I'm parsing words a little bit here, however, his proclamation of "I think this is all out war" is akin to Stalin on June 23, 1941 getting 200 intel reports from his western border then saying "I think we have a fight coming".
While my comparison is silly (even sillier if my dates are off :)), the NFL/Goodell v NFLPA/Brady IS all out war. No "I think" qualifiers are needed. It might have been "I think" weeks ago or even 5 days ago. But now it's the NFL's version of the German invasion of Russia. And if this judge doesn't rule "article 46 is in force, doesn't matter that is appears a sham, case closed", the battle of Stalingrad and Kursk are coming because Goodell, much like Hitler [and in more ways than one:)], is WAY too committed to turn his tanks around while saying "sorry Joe, let's forget the whole thing" (and Herr Goodell is also finding out the hard way beating Poland/lesser name players is not the same as beating Russia/Brady).

I'm torn on this. On the downside it will take Brady away from the field, at minimum a little, in the twilight of his career. Realistically he has 3 or 4 years left (unless he blazes a new age trail). This framegate could drag on and be part of Brady's schedule/thought process/active name for 50% of his remaining NFL career. That completely sucks for a good guy, a good competitor, a good asset for the NFL, a player that the NFL should strive to have all around it's teams.
But on the upside this is exposing the ugly underbelly of a sport/entertainment that is so big it is modern Americana, a part of the American fabric. This ugly fiasco is forcing a few people to look at it and even a few to review past NFL "independent investigations" under Roger Goodell. It's getting a few prominent and respected people to seriously question the NFL and Goodell. So ultimatelyI don't give a sh!+ if it is etched on a tablet as the eleventh commandment that Goodell can make grossly unfair decisions and railroad people, what he/they have done is patently wrong and cannot/should not be allowed irregardless of 'power to do'. So this war, while it will take its toll on Brady, is sorely needed. It has to come due to the progression/the graph that is headed in a direction that says Goodell is going to cause something that will end up marring this part of Americana if not cause a national embarrassment. (unless one is to believe that Goodell will turn the progression around, self-correct and stop being dishonoest with the.............damn! I almost made to the end of typing that statement without laughing but I just couldn't make it).

Hey lawyer types...

Anyone know what typical 2nd Circuit appeals timelines are like? If Brady wins and the NFL then appeals is there any realistic chance CA2 would issue a decision before the Superbowl?

I'm also going to assume/hope that while the NFL might ask CA2 to stay Berman's order pending the appeal , CA2 would refuse to because if they did it would moot the case within literally a month. (Hmm -- that would be a sneaky way to make everything go away. Grant the stay and then when Brady has missed the 4 games say that the case has been mooted and dismiss it.)

Berman said it could take until 2017 for the appeals process to sort out. The court of appeals would not care about having to issue an order before the super bowl. They'll get to Brady's case when they get to Brady's case.

patriae is fatherland or country...amans means loving I think...delenda est means must be destroyed

Forty years for some of us. As I posted elsewhere, we are becoming educated from this. First it was the science with Ideal Gas Law then it was the law with jurisdiction and precedent, now it's Latin.
Actually a better example might be Moby **** with Goodell as Captain Ahab and Brady is his white whale obsession..we all know how that turned out.

Mortui vivos docent.........

Emperor's New Clothes...this Goondell crap is an isomer of that tale

Germany..Ahab..I am still going with my interpretation of this

It was all-out war the second the appeal ruling came down. But McCann is very careful in how he words things, and I think that's a good thing. One of him is 1000x better than all the sensationalist, bombastic d-bags that planet earth has to offer.

This is disgusting. I don't remember Peterson or Rice being treated like this. Did Brady kill somebody?

I understand the sentiment DR. Hard to believe the NFL would stoop this low and go so all out simply just to have its way. Make no mistake this is now almost completely a fight about the NFL showing it can have its way whenever and however it wants. Goodell doesn't really care anymore, IMHO, about a stupid 4 game suspension. This about him/them proving they are all powerful - about them wanting to show they get their way in player matters, always.

So Brady's dogs might be small compared to the NFL's group of hounds, but Brady made far more public defiance noise than any other player before. Doing this Brady had to know he was going to get 'you mess with a multi billion dollar powerful bull you get the multi billion dollar industry horns'. The tentacles of the NFL were going to come from multiple directions right at Brady.

Goodell has predicated himself and his office on being a singularly powerful force that doles out harsh punishment to more than fit the media/public's outrage. His decisions get carried out and he doesn't back down/isn't made to back down. Every loss Goodell has taken was forced on him after a major fight -- and Goodell never backed down/softened his stances to any tangible degree in those losses. It's the school yard bully analogy: If the bully winces and turns away from a smaller guy raising his fists, everyone will see that and his bully power is now all but irrevocably diminished.

I thought the analogy was "if you stand up to the bully, he'll leave you alone". But Goodell is the bully who's now gotten the **** kicked out of him four times in a row... yet he still keeps bullying. Or trying to, at least.

Here's his piece on today's filings:

http://www.si.com/nfl/2015/08/14/tom-brady-filing-roger-goodell-deflategate-federal-case-analysis

McCann said:
There comes a point in any litigation when there is no turning back, when no settlement can be reached. It’s the moment when both sides are resigned to taking their chances with the judge or jury. Until then, they often wage all-out war. If Tom Brady and Roger Goodell fail to reach a settlement in their case, Friday will probably be remembered as the day when the point of no return was crossed and when the gloves truly came off.

In a seething memorandum filed to U.S. District Judge Richard Berman Friday night, attorneys for Brady ridiculed Goodell as incompetent and dishonest.

haven't thought of the dead language in 30 years...jeez

Makes sense since the damn language has been dead for like 1000 years... and yet my nephew insists on taking that as his foreign language. Yeah yeah I know its great that he'll be able to learn any western language he wants since he will know Latin... whatever.

I thought the analogy was "if you stand up to the bully, he'll leave you alone". But Goodell is the bully who's now gotten the **** kicked out of him four times in a row... yet he still keeps bullying. Or trying to, at least.

The key phrase is "yet he still keeps bullying". Goodell has never backed down. The courts might have smacked him down but he never lost tangible face from a 'this is the line in the sand I will always draw it any way I want' perspective. Doesn't everyone continue to completely believe if you defy Goodell you will have an ugly all out fight directed at you? And the more you openly defy him, especially if you make him look bad, the uglier he will get (and his face is already patently disturbing:)).

Given that how does he back down now after going so all in for everyone that defies him?? He simply can't allow that persona to be injured. He has to throw everything in but the kitchen sink to show he will never back down. Win or lose in the courts he is showing everyone the cost of defying him. Brady is paying a heavy toll right now for defying him and, IMHO, it will linger for Brady after the court case is over. I expect undercurrents of trouble for Brady from the league office as retribution. Small stuff, under the radar, things that there isn't much that can be done about. I'm certain that will be the case for the Patriots organization too. Goodell has been so underhanded on this and in the past, why would we expect he wouldn't use his power to send those small and hard to identify/defend against ripples of trouble toward Brady and the Patriots?
Just is what it is unfortunately....
