What does CA2 stand for ?
 
Is it just me, or does the NFL seem to not be aware that it was the Judge himself who steered the direction of the questions from this past Wednesday? Clearly, the facts of how the NFL arrived at Brady's guilt is important to Judge Berman, so I just don't understand their stance that all that stuff is irrelevant.

I was wondering the same thing when I read that part of the NFL's brief. Berman questioned the NFL side first on Wednesday. It's not like Kessler introduced the topic initially or urged the judge to question the league about it.
 
Stradley hasn't had anything about it yet. Someone shoot her the link, I would be interested in her take on the filing.

Can't wait to hear it too. But its Friday and she probably has more fun things to do
 
Right. Most likely it gets sent back to a neutral arbitrator but based on precedent a neutral arbitrator would issue a fine and now suspension.

Brady can avoid this uncertainty by settling.

I am a lawyer and my guess is this settles on Sept 3. Brady agrees to a hefty fine and no suspension. Lots of pressure being put on the NFL since their little PR crusade has no been exposed.

at this point, with the way the nfl is acting like a child, Brady shouldn't settle for anything other then an apology from the nfl. in exchange he wont sure for defamation

If somehow Berman ****s this up my hope is thousands of Patriots fans get on the field opening night to protest the injustice of the NFL while the game is going on.

Sounds crazy I know. But I'm just so angry and appalled by the injustice and fascist way the NFL has conducted themselves the last few years. Like they are above the law and can do whatever they want. I'm just shocked all the NFL fans don't see this for what it is.
 
I don't think Kraft's suing anyone for defamation.


Couldn't Brady use that as leverage? "If you return the picks, I won't sue for defamation"
 
What does CA2 stand for ?
2nd Circuit Court of Appeals, the locale for this case. Precedents are either binding or persuasive, Precedent in this jurisdiction (CA2) would be binding but decisions from outside are persuasive and influence judges but don't bind them. The fact that the NFL didn't cite any 2nd Circuit cases means there are no cases that would bind the judge. Different circuits often have contradictory rulings which can thendecided by a higher court like the US Supreme Court which would be binding on all...
 
Can everyone just end this already. Its becoming worse than the JonBenet Ramsey case. Its football season.
 
Isn't it just amazing it has gotten to this point, i mean after all the money and effort and everything...when you just sit back in your chair and think of all of this since January...

Reading Daniel Wallach's tweets, and the NFL's arrogance just comes across in spades.

The Berman should side with the NFLPA just based on the NFL's douchebaggery.

That...is so not true. That is super-clear in the CBA. That's why the NFLPA made as big a deal of it as they did.

Ah yes, we should thankful that the overlord's capricious and disproportionate judgement wasn't even worse. Well, when you put it that way....
 
If, and it's a big if, but if Berman sides with the NFLPA and based on his writing so far, Berman will take EVERY opportunity to absolutely bury the NFL and Goodell. THAT will be an interesting read.

In response filed tonight, NFL argues under federal law Judge Berman is not authorized to rule for Brady even if there are factual errors.

So Judge Berman is being told that he can't make his own ruling?
