Official Brady vs. NFL Federal Court 8/12 Thread (LIVE UPDATES)

I wouldn't get my hopes up that the NFL will be "reasonable".

It's because they are putting on a face, nothing more nothing less. This is more about them not wanting to set the precedent that player suspensions can be negotiated into fines.

And the judge probably knows it.
But as Florio pointed out earlier today, losing in court could be much worse and set precedent regarding the CBA the NFL will not want to be forced to follow. It is in their best interest to settle (moreso than Brady).

There are no further settlement talks scheduled for today in Brady case. NFL continues to insist on guilt admission I'm told

Is this McCarty-era America? This is utterly ridiculous. How can you possibly force someone to perjure themselves?!

Guess what .. they seem to talking and with Berman sometime today.

"Attorneys for Tom Brady and the NFL returned to court on Thursday to continue settlement talks over the New England Patriots quarterback's four-game Deflategate suspension.

ESPN's Sal Paolantonio reports that four attorneys for the NFL -- Greg Levy, Sam Nash, Jeff Pash and Adolpho Birch -- were at the courthouse in lower Manhattan -- along with attorney Jeffrey Kessler and others representing the players' union. The sides have met separately with U.S. District Court Judge Richard M. Berman, and plans are for the sides to meet with the judge together at some point Thursday."

I'm not worried about this because the only outcome I absolutely dread is if Brady decided to "admit" guilt in exchange for no suspension and the moment he went under oath the chances of that happening became 0%.

The league's case has a million holes in it, I feel confident that our team did nothing wrong and that is infinitely more important than a 4 game suspension.

Worst case scenario? Brady is gone for 4 games and JimmyG lights it up and we end up being able to trade him for a #1 the year that they stole a pick from us.

Not that I think the scenario is plausible, but you'd probably trade for a 1st after 2016 as the NFL stipulated that the pick taken will be the earliest first rounder that the Pats own.

Sounds like the league has no intentions of settling. They'd rather lose in court, and I hope they do. Berman has to see which side is reasonable, which side has twisted the facts (or lack thereof), and which side has refused to concede anything.

The league is acting like a bunch of arrogant punks and the NFLPA has been more than reasonable.

Funny, too, because the NFL stands to lose a lot here. I think there might be a bit of a conflict of interest between the league and Goodell. Goodell would probably rather lose than compromise, since the latter would be more damaging to his hardline image.

But the league has to be pretty scared right now. If the judge actually rules against them, a significant part of the commissioner's perceived authority could basically be neutered on the spot (pending appeals). If the judge explicitly rules against the NFL's interpretation of Article 46 as "I can do whatever I want whenever I want for any or no reason", in a case as high-profile as this one, it should embolden all players who are suspended under similar charges in the future.

It's not like he only excused Brady. He said Brady and Goodell don't need to be there, although he could change his mind.

Goodell has to avoid the optics of public mockery. "Boo the Liar"

Absent the two principles, this case will not b concluded 8/19

NFL position is deranged MT @riverhawk02 NFL atty on record in Berman's courtroom saying theres no direct evidence, yet NFL insists on guilt

Reflect on this, people.
I believe that this in essence describes the fundamental core of this tempest.
The NYJFL League Front Office and several other NFL team organizations believe, no they KNOW that the Pats (read BB) cheat. They just KNOW it. So evidence per se is utterly irrelevant. What counts is that the Patriots must be punished, severely, in any & all ways possible.

This perverse belief which they sincerely hold explains their irrational actions.

I wonder why the judge is now saying goodell and Brady don't have to be there next week. I really wanted to see goodell answering questions. It makes me think they are close to a settlement but all indications and news today points in the direction that next Wednesday will get here with no change.

JimmyG lights it up and we end up being able to trade him for a #1 the year that they stole a pick from us.
I believe they'd have to give that up, if I recall correctly. Don't know if they'd get back their own, if they do trade for one, though. I think if they trade for a #1 in 2016, they have to give up whatever one is higher, their own or the one they traded for. Naturally, it'd be the traded for one since they're winning the SB again.

I agree with this. The best thing that happened was the NFL admitted they had no PROOF ! Even if the judge is forced by the CBA to keep the penalties the same, it's out there for everyone to see, they have no proof.
