Very smart move by Kessler, telling the judge Brady could have handled his meeting with Wells better, i.e the phone on advice from Don Yee. Opens the door for a "fine" for non-cooperation.
Also tells the judge Tom isn't perfect. I like it!!!!
 
It can still go both ways if they don't settle. If the judge is somehow convinced that deflation occurred, he may just punt it and say, that's the NFL's CBA discretion.

In fact, the only thing that might be holding Berman back from giving the NFL carte blanche is the extreme harshness of the punishment. He may feel that's where he has to step in.

If it was a smaller punishment, he might have just kicked them out of the court room.
 
How did he get his cell phone into federal court?
Claims he was tweeting from the press room, where he was observing the proceedings over closed circuit TV.

I hope Goodell is swayed to change his plans for opening night and shows up in Foxboro so Brady can bathe in his blood after he annihilates the Steelers on national TV.
 
What are you going on about?? What does Ray Lewis have to do with this? I'm telling you what Kessler basically said in court..

The analogy is taking a small penalty for obstructing investigation of what an associate of one's may or may not have done, and having that not be a lingering stain on one's reputation.

I thought that would be evident to readers of the thread, but I forgot that you also would be participating here. My bad!
 
You don't know who Garafolo was referring to. Stephen Brown is a court reporter. That's pretty official.

Brown is an employee of the New York Daily News. He is a reporter (in the journalistic sense, not the legal one) who apparently covers the Manhattan courts for the NYDN.
 
This is a court case, not Pardon the Interruption. Kessler's job is to get Brady the best possible settlement or decision that is in his capability as a legal representative, not to salvage the reputation of the Patriots by convincing some judge that they aren't cheaters. Whatever line of answers is most likely to benefit Brady is the correct line of answers. Kessler is a high profile lawyer who probably came to the conclusion that directly contradicting the premise of the question and arguing with the judge over whether or not McNally deflated balls would not serve the best interests of his client in this case.
I understand that and I'll even concede that Berman might have telegraphed his (mis)understanding of the inflation issue in chambers beforehand; maybe, even, Kessler means to touch on that in this followup submittal. But I'd have brought it up anyway. Maybe I'm just more combative than a NY lawyer.

Except the question isn't simply a matter of "Were the balls deflated?"

The question is, "Were the balls deflated, and, if so, did Brady have an active hand in causing that to happen?"

Using the first question would be like suspending Matt Ryan because the Falcons pumped in fake noise.
