IMO, still pointing towards the judge knowing Brady doesn't DESERVE a suspension and applying significantly more pressure on the NFL side to settle. I think its because he knows in the end, he will side with the NFL while ripping them, so he hopes it won't come to that. NFL is not going to settle, Judges have called Goodell a liar and no one in the public really cares because 4 months later he's leading DeflateGate. Don't feel any better today than yesterday.
 
I liked his questioning of the NFL but his questions to Kessler seemed to suggest that he holds to the notion that someone did tamper just that there is no compelling evidence that it was Brady in particular. I didn't like that. I wish that Kessler had hit harder at the evidence showing that no tampering occurred, that there is no foundational bad act under this whole thing.
This is a court case, not Pardon the Interruption. Kessler's job is to get Brady the best possible settlement or decision that is in his capability as a legal representative, not to salvage the reputation of the Patriots by convincing some judge that they aren't cheaters. Whatever line of answers is most likely to benefit Brady is the correct line of answers. Kessler is a high profile lawyer who probably came to the conclusion that directly contradicting the premise of the question and arguing with the judge over whether or not McNally deflated balls would not serve the best interests of his client in this case.
 
For all you who think the judge believes the balls were tampered with, he brought that up since it was the only way he could try to point out Brady's potential involvement.

Basically, what he did today was this: both of you guys think you're right. Well, let me make you think long and hard about why you shouldn't be 100% confident in your case. Then maybe you'll be more open to settling, since your case kind of sucks, when you think about it.

The idea was to erode confidence. How would he do this by making an open ended statement like, "Mr. Kessler, tell me how you think the balls came to have a lower air pressure..." He tried to take the weakest, or most vulnerable points of both cases, to show both sides that they aren't as ironclad as they thought.

A smart tactic by a judge who realizes that a settlement is the best way to resolve most issues, although I don't think this one can be settled because the sides cannot even agree that a violation occurred in the first place, let along whether the punishment or process was fair.
 
If the NFL had a smoking gun that Brady cheated... we would have heard it. It didn't happen.

Should be interesting to see how much they soften their demand that he admits guilt.
 
Kessler did just what he wanted to, he has a plan, and I am sure his answers had a bit to do with talk with Berman before.

Thats what breer and our local media will say. Iam sure wetzel etc will pick apart the NFL grilling .
 
This is looking like the end of an episode of Suits where the big evil corp. goes to Harvey & Mike to settle it before they lose in a major way.

If Goodell digs in, he's out of work oror he can slap a 50k fine on Brady for "non-cooperation" and have it over and done with.
 
Many have said that based on the questions Berman asked, he would be giving a hint as to which side he supported more. Along that line of thinking, I would say he pretty heavily hinted that the NFLPA's position has much more weight. He was basically saying "NFL, settle this now and take what the NFLPA will give you before this gets much worse for you." Again this is IMO
 
I don't think he was throwing Yee under the bus. Again, we're only getting words, not nuance.
Brady is responsible for his own actions but I think Kessler may be trying to approach this from an angle of "Brady refused to share on the advice of counsel, not because he personally decided to be uncooperative."

Ya i'm sure Yee had no knowledge ahead of time that they might have to do that. Or the fact that Yee has been record for the last 3 months saying that's exactly what he did.

I don't think the judge mentioned the cba at all to Kessler. i would think if he was gonna just side with the NFL based on the cba then he would have mentioned it atleast once
