Unfortunately Kessler has to prove 'Brady had no knowledge' and he doesn't have to argue 'nothing wrong was done' -- that was for Kraft to argue and he laid down
 
Not liking Kesslers answers, I assume he is going somewhere with it. Why say the balls were deflated cause of science ? Unless that would poison settlement talks
We are reading 1 sentence rehashes every 3 minutes. Pretty sure more is being said with the other 2 minutes 50 seconds.
 
This is so moronic....

Air leaks out of everything. Especially in the cold.

If you fill a ball up to the lowest possible allowed PSI (12.5) in a hot room, and then bring them outside where it's freezing cold and rainy, they're clearly going to leak.

Yet, we're in a federal court house.......seriously, I hope history brands this as the most moronic "scandal" of all-time. Goodell should have to serve time in jail for seriously wasting everyone's time and burning their brain cells. Unbelievable.

This isn't a criminal proceeding. Kessler doesn't have to prove Brady had no knowledge. He simply has to show that there is no basis for this punishment, by whatever means.
 
Oh, come on, Kessler. That is seriously weak.

We have no idea what was said by the Judge behind closed doors. Kessler likely got an indication of what the Judge thinks Brady's weaknesses are, and Kessler will specifically tailor his arguments to address them. Sadly, yet another opportunity for unsubstantiated speculation.

Bottom line, Kessler's presentation will be based on numerous bases we will never know about.
 
I would guess that he's leading to "even if you accept that the deflation happened as the NFL assumes, you still have little basis to assume that Brady was in on it". Ties back into Berman's argument that you have to show that Brady intended to be part of a conspiracy before you can punish him for it.

The fan in me wants him to lead with "there's no good evidence that deflation occurred in the first place", but there's a reason why Kessler gets paid a ton to do this and I'm just some guy on the internet.

He was answering the question "why would someone do it without Brady's consent." That's all. he didn't say anyone actually did any tampering.

No need to overreact.
I wouldn't accept the premise of the question. I would point out that the evidence shows that there was no "it" that was done.

That would be some quick thinking if so. I didn't make the connection until a full few minutes later. Again, why Kessler is who he is and why I'm some guy on Patsfans.
