NFL trying to argue to the judge that the independence of Wells doesn't matter under the CBA.

Michael McCann retweeted AP NFL

Judge Berman likely won't say which side has better case. He doesn't want to advantage one side in settlement talks.

Michael McCann added,

#Deflategate judge says both Brady, Goodell have strengths in their arguments. Undecided on who will prevail. http://apne.ws/1IKILXf

I know it sounds really great for us from the tweets and it's great that Berman is giving credence to a lot of the points that Kessler contended, but everyone should try not to get overly excited until we hear what Berman has to say to Brady too. Berman himself stated that he sees weaknesses in both sides, and we don't know what he has in store for Brady and the NFLPA yet.

Nash: So-called independence of Mr Wells, is...a complete red herring. Under the CBA it is not an argument that has any legal significance

Berman now turns to findings of Wells Report. Continues grilling Nash. #DeflateGate
Hahaha, and only yesterday Goodell said it was independent. I wanted to know fi the judge asked nash if the report was independent or not yes/no.

Anyhow Iam sure the judge is going grill brady's team next. So not getting too excited yet.

This. He is going to push Kessler as hard as he can too. He will ask some questions that make us uncomfortable. Nevertheless, I love that he is asking about "direct evidence."

Berman: Turns out Mr. Brady did better with higher inflated balls than underinflated balls. You might say he got no competitive advantage

----

Well... yeah.

Berman needs to ask Nash and Goodell straight up, is the Wells report independent or not. Yes or no.

What a question, what a question. I think I love this judge already.
"Is there any direct evidence linking Mr. Brady to tampering?"

Berman: I’m trying to figure out what is the direct evidence that implicates Mr. Brady in that deflation…in that bathroom…on Jan. 18
