Curran: Time for Brady to think hard about making a deal

I've dealt with some VERY ****y New York lawyers who actually had lousy cases with long track records of losing similar cases. I have some sympathy for the media who are being fooled by them.

That said, there's one way Brady could take a settlement without being locked in as a loser -- if he makes it VERY clear that he will quickly be filing a defamation suit with a VERY large number attached.

"1 game, $250K, and no admission of guilt of any kind. Done and done. FYI, by the end of the month, we'll be filing a defamation suit naming the NFL, Roger Goodell, Jeffrey Pash, Theodore Wells, Wells' law firm, Mike Gardi, Mike Kensil and several John Does as defendants, with requested damages of no less than $80 million. We plan to file in Massachusetts, Judge Berman, but if you feel strongly it should be in your court instead we're of course delighted to listen."


Could the NFL then counter that with stating 0 games, 10,000 fine and the request of Tom Brady and the NFLPA to not move to a defamation case?


At that point I would tell them to go **** off...

That's when the decision gets hard for Brady, given the difficulty and distraction of pursuing and winning a defamation case.

My gut reaction is that if the penalty is COMPLETELY eliminated, he should seriously consider dropping the defamation case, but not otherwise.

And even if he does sign away his rights to a defamation case, he should -- probably one time only -- engage in some very pointed name-calling and dare them to fine him. He should call lies lies, liars liars, frames frames, disgraces to the office disgraces to the office, and so on down the list.
 
I think its one thing for anyone outside to comprehend anything but exoneration , its another for the man himself to be in front of a judge who tells him to settle or take a chance of losing 4 games. Its not easy when one's ownself has to make the call and decision. I think that is curran's point. If NFL offers 1 game then brady refuses what does the judge do about it .? Does he think one party was willing to settle and others arent.
I hate to even imagine if brady thinks of even paying a fine (as Steph Stradely said, not sure why goodell is big on fines which anyways go to charity like he did in the bountygate case) but the reality may be different in front of the judge and when brady himself has to make a call. I dont envy his position tonight and tomorrow however strong a case the NFLPA has.

If NFL fines go to charity then it makes Goodell look good. More propaganda tools for him. That's why he's big on fines.
 
I think Curran's point is that it's no longer about whether or not he did anything wrong.

It's now about a bunch of suits fighting in court over whether or not the commissioner has the proper authority to dish out this kind of punishment, as they argue about the fine print in their labor contract.
It was never about Brady doing anything wrong supa. That was obvious the first moment correct and factual information came to light. This is and has been about NFL corruption, the abuse of power, and framing an innocent man for a crime he did not commit. If anything, the NFL should be running scared.
 
I do not think Brady should make a deal until he gets a feel for what the Judge is thinking, if when they convene today and Judge Berman suggests strongly to Brady that it would be in his best interest to settle, then settle. If he strongly suggests that the NFL settle then Brady should push it..

Most of the posts on this litigation indicate that the Judge will pretty much lay out what he is thinking.. until they know his thoughts do not budge..
 
Curran is forgetting that this isn't only about winning and losing football games.

As somebody said before the most recent Super Bowl -- it's about honor.
I've said this many times before as well. Money, games, being there for your teammates? They last awhile. His legacy will be in the history books FOREVER. If he truly knew nothing, settle for nothing. I believe he will settle for nothing. The man has principles.

He's not in a position of accepting a plea or face a 15 year prison sentence. It's his innocence, integrity, and legacy at stake vs. 4 regular season games. He needs to stick with his convictions or he will forever regret it.
 
Curran has been great and I understand his pragmatism here. But also remember as good as Curran is, he is a member of the media club. He runs in media circles, he talks in media circles, he hears feedback from those media circles, he gets news tidbits from those media circles. His thought process will be affected by the media circles, and the stories he goes with can be influenced.

Now consider this: Would the NFL just before the deadline to make a deal put pressure on Brady by using its powerful behind the scenes media machine to disseminate lies or scare tactics in the hope it revs up the media circles talking about why Brady should be afraid/why he should just get out while he still has the chance to get a reduced punishment?
Does anyone believe the NFL bullying machine won't/can't inject ideas in the media circles? Does anyone believe the NFL wouldn't do this?

The deadline approaches before the thing is all but unchangeably within the hands of a judge. Expect stories to come out that urge Brady to be worried in order to settle by the deadline. Expect even Brady supporters in the media to be indirectly influenced by the NFL media machine.

What exactly is in it for Brady to settle? Can someone tell me how Brady the man is helped by a 2 game suspension versus 4 games except for 2 gameday paychecks (which certainly is nothing to sneeze at)? IMHO Brady looks much better going down with the ship fighting Moby Prick Goodell to the end. If it's unchanged and remains 4? He isn't any worse than he was yesterday is he? Than immediately Get the damn thing to into appeal and get another judge to look at it. (and remember this assumes the worst case scenario with this judge. Why is the worst case even expected?).

Yep, we're being played. Curran joins the bendover brigade, while twinkie boy cuts and pastes his "Brady's gonna win" article, from stuff he's read.
 
What I don't understand is HOW we ever got to this point, when the Wells report produced the following statement on page 228:

""In sum, the data did not provide a basis for us to determine with absolute certainty whether there was or was not tampering as the analysis of such data ultimately is dependent upon assumptions and information that is not certain."

Yeah, but he contradicts himself with the above comment stating that there's not even proof that anything happened.

One would think that such a statement would be fairly important, since it was part of the final report issued by Wells.

It seems odd that one can make such a strong statement only to go on with talk coming from the complete opposite direction.
 
I've got a way we can compromise without losing any games or paying fines. We just agree not to come in first, so parity's maintained and we get two different storylines in the Super Bowl.

This is what the league and the media want anyway and Tom still gets to compile his numbers and pass Peyton Manning. The league just decides which two teams they want in the super Bowl. that way they can start hyping the future matchup and get more for their advertising dollar.

Say it's the Colts. If Blount breaks free into the defensive backfield, he just needs to fall down, maybe fumble once in a while. Those panic prayers Luck throws up when pressured? Hands off, let them drop. If they can find an NFC quarterback who's also hyped to the max, but hasn't done anything, there's your Superbowl!

Since Judge Berman is supposed to evaluate the process only ( and not the underlying facts) here's a settlement offer from Brady's side that comports with everything and has been suggested previously on this Board.. Stay the suspension and get a neutral arbitrator approved by BOTH sides or in the alternative, stay the suspension and collect PSI readings pre and post game for ALL NFL games this year and publicly release them as the season progresses (and have a member of the press witness the record keeping) and evaluate after the season to see if nature and the Ideal Gas Law caused deflation. It is in the interest of justice to prevent an injustice...
The risk of harm is too great as Brady can't get those 4 games back.

And Wells could do this only if he knew the conclusion the NFL had predetermined. That's the reason Pash was "co-investigator". And bring me Goodell's phone and emails. And stick a mic in front of some owners and ask why they permit the lies and corruption.

That's why I want he media to witness it. What's your alternative? The chances of hanky panky if it is being witnessed * (*anybody but ESPN) is minimized even if not eliminated.

I have been arguing this for quite a while now, do it under the auspices of some University and make sure everything is recorded for all games if not practical do it for the games that are played outside.. I call it a longitudinal study of the effects of environment and use in NFL games played in non climate controlled conditions..

You don't think goodie is trying to fix the results to get teams from different markets into the Super Bowl? In the first place, that is his stated intention. He says openly he wants to change the draft or other conditions to prevent the same teams from succeeding every year.

Case in point, taking draft picks and benching the quarterback of the super bowl winner 4 games.

Secondly, that was satire, and the best satire is uncomfortably close to the truth.

The alternative is to let the NFL Clown College do whatever they want with the footballs. If you're a quarterback, grab a football and throw it to a receiver, couldn't be simpler.
