Seems that they've tried to settle and have reached a stalemate- again. So it seems at this point it doesn't make any difference.
Or they had no intention to settle because NFL doesnt gain anything by settling. If the judge throws out the case they can blame the judge and move on in their corrupt ways.

It's going to come down to whether the Judge will consider the findings of the Peterson case or not. If not, he will find that Goodell was within his rights under the CBA. Still could go either way. I *hope* that the judge respects the spirit of what the NFL is trying to do here, which is essentially moving the goalposts. But who knows.

Yep and to be fair, TB12 also has no inclination of settling.

Im sure Brady would settle if it came down to a fine and some concrete clarification on why he is being punished. But it seems that the NFL won't even consider going down to 3 games let alone doing that. So it seems to me Brady and the PA are acting in far better faith than the NFL during this process.
 
This is why I'm concerned about Kessler not prominently featuring the fact no ball deflation actually took place.

Still, I only read to page 20 of the Minnesota submissions as directed by one of the illustrious posters on this site. But failing to fully read a document is no bar to having an opinion on the entirety of the document, right?

Demonstrating that no ball deflation took place is not the best argument.

Arguing that the league had punishments in place defined in the CBA and were disregarded makes the most sense. In addition, calling out that the league NEVER documented what the actual starting PSI levels were demonstrates that the league had a muddy foundation in the first place.

Really, do you really expect an NFL lawyer to tell the truth: "We're screwed. The NFLPA has us over a barrel. We better settle quick on Brady's terms in order to avoid having Berman set a precedent curbing commissioner power" ?

1 vacate
2 submit to impartial arbitrator
3 uphold

It looks like the league thinks 3 is a low probability. 2 would be a disaster. Better to tank it and have the court vacate.

I guess for me I'm surprised more that he spoke out saying he won't reduce the suspension, when I thought they weren't really suppose to be saying anything right now.
 
You can yell, "Erroneous!" until you're blue in the face, but it won't change the fact that Chaz Reinhold lived with his mother until he was 40 and she tried to poison his oatmeal.

The deflation was not the basis for the Arbitration decision. If Kessler argues there is no proof of deflation, Berman will turn around and say "that is a finding of fact" and will defer to the original fact finder (Goodell). In order to defeat the Arbitration Decision, you have to attack the basis for it.

LOL, the league will ask Judge Berman to have Harold Henderson as a nuetral arbiter.
 
Colour me nervous. I'll be happy as long as Brady goes down fighting. Accepting a 1 game (or any really) suspension for any reason strongly infers guilt. I'd rather see him serve 4 while screaming "I didn't do anything".
 
Any Patriot fan should be happy with these claims. The league would be quiet if they believe they were on solid ground, the fact that they are ignoring Berman's order and shapeshifting their arguments make clear they are scared sh.tless and trying to get out on front of something they no longer have control over. Brady's side is quiet as can be and the league is in panic mode. Sweet.
 
The NFL has a terrible track record in court, this kind of stuff and the way they go about making decisions is why. At this point I'm 95/5 this will go Brady's way.
