With the first public settlement conference coming up on Wednesday the 12th, I think it's time to open official forum speculation on what's going to happen.

In the deep recesses of my mind here is what I think..

Berman looks Goodell in the eye and advises him to settle this thing, as you will lose big time in Fed Court..

Goodell asks how??? Berman tells Goodell to do a longitudinal study of the variation of air pressure in all game balls in the 2015-16 season to assess the effect of atmosphere/temperature on the footballs.. and if they respond as most of us believe they will respond, drop all penalties and apologize for being a first class butthole.. then resign.
 
I do not think Judge Berman wants to run this through his court but might see the deficiencies as too much to overlook and will rule to vacate the suspension and send it to a neutral arbitrator.

Roger cannot reduce his suspension to 0 games and 0 fines. He would not survive the backlash. IMO

Brady doesn't look like he will accept anything other than 0 games and 0 fines. Roger cannot do that.

That leaves to question if Brady would forfeit the right to sue if given 0 games and 0 suspension. I think he would but if he did sue the discovery process, if transparent, would be juicy.
 
I was looking for a youtube clip to express my thoughts on this but couldn't find it.

It is from the Woody Allen movie "Take the Money and Run" where while sentencing Allen's character, the judge takes off Woody's horn-rimmed glasses, throws them on the floor, and stomps on them.

That is what I see Berman doing to Goodell.
 
I voted for berman upholds simply because the only thing we've won since this started is the superbowl.

I have had my hopes and expectations destroyed so many times during this that I am afraid to think otherwise.

Also, the fact that this decision is procedural and not about the actual facts of the case could allow for it to be upheld.
 
I just can't see how he upholds it. The CBA is 100% worthless if Goody Goodell gets away with this one.
 
The next owner's meeting is the 11th, right? If the owners have any sense at all, they will pressure king moron to settle - appoint a neutral arbitrator. (Although, I hope they fire the piece of crap.) But, they may just hate Brady enough that it goes to Berman vacates - appoints a neutral arbitrator.

I can't see a straight up win for either side; there are too many attorney's fees yet to be had.

That's what I'm afraid of as well. Berman may feel his hands are tied and uphold on technical grounds while verbally berating Goodell.
You know the saying, "The Law is an ass", meaning it can be stupid and inflexible.

I think it goes re-hearing with neutral arbitrator. I'm vacillating between that being Berman's ruling, and that being Berman's clearly intended ruling, inducing a settlement.

Why would he do that on technical grounds? I don't understand why Ray Rice would win on CBA violation but this case wouldn't despite a loooooooooooooooooooooooooong list of CBA violations. I mean, why can't Goodell just say **** it salary cap is cut in half now I'm in charge like you allowed me to be so just deal with it. If this case doesn't win then Goodell essentially can do as he pleases and the CBA is garbage. This case goes far beyond Brady imo.
 
I think the only thing the judge is looking at is the process the NFL took verses the agreement they have with the NFLPA. I don't think he will rule on anything either way. Just that the NFL exceeded the collective bargaining agreement and will call for an independent arbitrator.

Then the arbitrator will look thru the evidence and decide what if any punishment there should be. So figure into the beginning of the season before this pile of excrement gets cleaned up!
 
Berman upholds suspension.

Integrity of game is more or less a way of saying, Folks, this is show business. We are like pro wrestling too. This isn't contractual at all. It's like firing an actress because she can't do a British accent.

I don't believe Rice ruling was based on "Integrity of the game" violation. "Integrity of the game" is very broad and the CBA allows the commish to interpret what it is. That's what scares me. Nothing in section 46 of the CBA says anything about fair or impartial. OTOH, the CBA rests on top of a whole bunch of labor law, so who's to say what Berman would rule.

I'm looking forward to reading the 15 page briefs from the two parties which are due today.
 
The more I think about this, the more I am convinced the other 31 owners don't care about the integrity of the game, finding out what really happened or getting the punishment right. Goodell is just an errand boy and this is about parity or better stated, the lack of it since Belichick and Brady have tag teamed the rest of the league. That's the motivation here. Restore parity to the league so every owner can have their turn at the top. So my friends, enjoy this for what it's worth. As time goes by the truth will be revealed and it will only strengthen the legend of the greatest, most dominant football team that has ever played the game.

You have to keep in mind, what the owners say publicly doesn't necessarily mean they feel that way privately.

I voted for what I hoped for (Berman vacates suspension), but I really have no idea what is going to happen. Nothing in this mess has gone our way so far.
