Craft a Potential Settlement

Looking for some input / ideas as to a potential settlement for Brady and the NFL.

Assume you are taking into consideration the position of both parties, regardless of how wrong you believe the NFL might be. Is there something that could be agreeable enough to both sides in terms of:

a. suspension
b. fine
c. a statement from either or both parties or a joint statement
d. neutral, binding arbitration of some kind, and any parameters on that (high / lo agreement of some kind? work potential reduction of patriots team penalties into the arb somehow (a dream on my end . . . haha); some form of agreement of what the arbitrators decision will and wont get into (eg will some or all of his reasoning remain confidential or not in the written decision))

Lets be creative and get this done beyond simply "how many games will each side accept," cause im guessing there may be more to it than that, if they do get it done.
 
Four games would be fair IMO. I doubt Roger accepts anything else. Roger is very deserving to sit out 4 weeks and Vincent can easily replace him and do an almost equally as bad job.
 
Neutral arbitration. Paul Tagliabue as arbitrator. It's really simple.

As much as it concerns me that Tagliabue might not be totally objective, I'd be willing to chance it. The Bountygate arbitration showed that he's willing to be objective, consider precedent, and undermine his successor if it's determined that Goodell ****ed up.
 
- zero punishment for Tom Brady
- zero punishment for the Pats
- removal of arbitrary powers of the commissioner by implementing a standard of discipline for all violations
- standardization of gametime preparations
- review of conflict of interest policies for employees of the NFL front office
 
Any settlement that does not include Roger Goodell's resignation is a non starter

I was going to say a firing squad (literally, not figuratively) for Goodell, Kensil, and Pash. Boy, you aren't a tough negotiator at all.

so in other words, desolve the New York Jets?

Full vindication and nothing less.

We already know the worst case scenario for Brady and that is 4 games. We do not know the worst case scenario from an NFL perspective which could be a lot more damaging.

If Brady ends this now and settles for anything he will weaken his chances to pursue any other avenue.
 
The news coming out of the owner's meeting next week will be stupendous.
 
Considering the team has already seen the harshest penalty in league history, I see no reason why Brady should see any punishment at all. The compromise has already been made.
 
  • No suspension for Brady.
  • No fine for Brady.
  • Neither side to admit the other was right.
  • Brady to sign away his option of pursuing a defamation suit.

or

  • Neutral arbitration, with ...
  • ... attorney/client privilege waived by Wells, his colleagues, and Pash.

The problem here is no one knows the motivation of the NFL.
For example, why would the league care about Brady admitting guilt?
They feel they have an inalienable right to pronounce him guilty and feel they only need 'more likely than not, generally aware' so why would an admission even be asked for much less expected?

That said, if both sides feel they are right, then they can take it to a truly independent arbitrator. One of the catches is though, that the NFL cannot hide discovery from Brady, such as not revealing Wells investigation notes, details, inteviews and work that did not get into the report.
If the NFL believes they are right, Wells was right and Brady is guilty, why would they not allow him, or even want him to have a fair appeal.
 
There are two solutions that I think would be acceptable to Brady and that might work with Berman:
1) Exoneration on the underlying charge, no suspension, acceptance of a fine for something to do with "non cooperation"
2) Referral of the entire matter, with an unsealing of the original "Appeal," to a truly independent Arbiter, who will clearly find that the entire matter was absurd and won't even fine him for not co-operating. Waiver of Attorney client privilege by Wells.

If I'm Goodell, I can't acccept 2), so I'd accept 1) rather than take my chances that Berman would Vacate the ruling in the court to which I brought the matter in the first place and risk getting nothing.

I also wouldn't mind if goodell gets hit by a truck as well

  • Goodell and the league office gets five minutes to look through the pics of Giselle on Brady's phone

I think August 12 will be the key to this entire process.
This will be Brady and the NFL sitting in front of the judge who will decide the case explaining what they are willing to settle for and why. The judge's response will probably be a dead give away to where he is leaning after reading the initial filings, and more importantly how far he is leaning.

I don't think he pursued this on his own..........I believe there are owners behind it......I want him around long enough to divulge those owners......then run him over
 
My offer is this: Nothing! No suspension. Return the draft picks. Goodell to apologize and to pay the $1 million dollar fine personally.
