I've had the crappiest day from hell that has nothing to do with brady or psi but what an fn joke. So Brady's lawyers show in the appeal how absolutely flawed the NFL's "SCIENCE" is and now the whole 4 game suspension of the current SB MVP rests on his cell phone. This can't be incompetence. They hate brady.
 
The league looks great right now. Goodell went hard after perhaps the biggest star in the league, never backed down, and had his belief (and that of many others) confirmed that Brady had something to hide when he erased the phone. The story that has been written is that the Brady did SOMETHING (what it was is unimportant), lied about it, destroyed evidence and proved Goodell right for taking a principled stand from day 1. It is unlikely that any federal court decision is going to change this narrative, even if Brady gets the suspension reduced or overturned. Barring a miracle, it's really all over but the shouting.

I think what perhaps you are trying to say is that in many if not most eyes, the Haters will always believe he's guilty no matter how the rest of this plays out. You're right - and the NFL has been playing their PR game to control public opinion well - perhaps TOO well

I think there's some reporters out there like Sally Jenkins who are probably taking their time to really grasp what Goodell is pulling here - it's a slimy move on MANY levels and there are some out there who will ask the right questions - not that Goodell would ever answer. But the public trail of set up and deceit is out there for the ages.

Brady is saving his "say" largely for the courtroom. No matter how this plays out you can bet once it's over Brady will likely be frank about how he views the Commissioner's attempt to corrupt the NFL offices

That might have to wait a few years perhaps if Brady chooses to have his immediate revenge by playing a few years longer and scoop up a few more Lombardi's in a "Vengence" Tour ;)
 
I didn't hear him say that specifically.

I know Doty is old but him being retired is news to me. The website says he is still active.

Doty is now a senior judge. He can pick and choose his cases. He could still end up with this.
 
I'm not willing to accept that the phone was actually "destroyed" as opposed to just the data was deleted, but in either event, The mistake was to delete the data or smash the phone, whichever version is true, as opposed to just putting it away in a safe somewhere or safe-deposit box. Once that was done, if you are headed to court, and if the other side is allowed to do discovery, you might have to say it then. Better to get it out now.
Legally Brady had every right to do what he did with his phone. Just doesn't play well in the court of public opinion.

This has been addressed already.

There is no spoilation issue with this personal phone. It is not something any court could ding you on.

Well apparently Dale was wrong according to this

Kyle disqualified himself because he formerly worked for the law firm Briggs & Morgan when he was in private practice as an attorney. Kyle was the lead counsel in Minnesota for the NFLPA in the White case.

I don't post here often but I just have to rant and probably a long rant for my own sanity
Tom Brady's INNOCENT! That's where all the evidence leads yet an incredible propaganda campaign in the NFL to cover their own butt is what people want to buy because they hate people on top.

The people that want to say he's guilty use a logical approach. The cell phone is not available on the date he was meeting with Wells!
He calls himself the deflator and the idea it's weight loss is laughable !
locker room attendant texting back-and-forth about getting free stuff from Brady and inflating the balls to high levels !

to these people this is evidence of guilt because who would destroy cell phone the day they meet the investigator, what are the odds someone call himself Deflator and then later be accused of deflating footballs, that's it, that's all the logic they need! Guilty!

However if you use actual logic you should then say the following
- Tom Brady cares so much about the pressure in the balls that he's OK with the ball attendant letting out air Random PSI levels?
- Brady, like most powerful wealthy people, change their cell phone regularly and the fact he came back into the country after the Super Bowl, it makes kind of a lot of sense for him to change his cell phone then, it also makes sense to meet with Wells when you get back into the country, I'm sure he planned a lot of things for when he got back into the country because there's something you're not going to do while you're out of the country and on vacation so taking care of things when you get back probably bunch up a lot of those things to the same timeframe, I bet he did his laundry around the same day as he met with Wells, maybe you should investigate whether he had evidence on his clothing!
- Why was the other cell phone available? well maybe he just put it aside and then someone forgot to destroy it or he kept it as a backup but since he was switching to an IPhone which is a different platform he had no need for a backup phone. Since he seems to switch phones every few months it seems like that would be Hundreds of phones available that were not destroyed but there seems there were one or two which leads credence to his position that he normally destroys the cell phones. And since deflating was going on since 2013 why would he keep that phone because it must be evidence on there too
- Wells insinuated that deflating had been going on for a while because of May 2014 text the guy calls himself The Deflator but the cell phones from before November 2014 were of no interest to them. WHAT?
- in regards to the deflator text. The second use of the word deflate in all the texts were in the Green Bay game but he tells the guy to deflate and get rid of the jacket at the exact time the guys on TV wearing a ton of clothes which makes him look like he's 300 pounds and trying to give Jacket to a player, please tell me what logic anybody can use that that text had anything to do with deflating balls and since he's already ripping him about the jacket is it then possible and likely ribbing him about looking large on TV and telling him to deflate. If that is the use of the word clearly has nothing to do with deflating footballs then how can they use a 2014 text as any evidence related to deflating footballs.
- Brady has a future HOF vote years down the line and these two equipment guys know what went on. Tom Brady comes out explicitly says he's not guilty and then one of these guys comes out years later or NEXT WEEK and says he was Guilty and Tom did it and this person can probably get a large payday for the story and discredit Tom. There is no logic to Tom putting his entire reputation on the line when there are two guys that could rat him out at anytime.
- also I saw some analysis which indicated they could show that the patriots logo was used on the patriot balls for the game if that's true then none of the balls were out of spec even going by Wells own report, never mind the fact that the science is shoddy and everyone has discredited it and the only two people that seem to agree with it are the ones the NFL paid to testify for them
-If the guy calls himself the deflator and it is evidence of guilt in 2014 that means in the 2013 season he was doing this yet somehow in the AFC championship game this is the only time any referee remembers him taking the balls special like he did So if he has been doing this for three seasons how did he do it ? He never took the balls like he did on the AFC championship game so how is he doing it all this time? Wait, what? there is absolutely zero evidence other than one text that anything was going on with PSI and balls before the Jets game? So why would anybody logically think the text in May 2014 had anything to do with the deflating footballs? Only because in January 2015 he was accused of doing that . Logic would dictate that would have to be some evidence before that day but there isn't
- also why would a guy say that he would have Brady's footballs over inflated and that only his passer rating would deflate? Well could be perhaps that he told the referees what PSI to put into the ball ? He could easily have told the ref that Tom Brady likes the balls and 13.5, saying jokingly to get back at Tom that the balls would not be to his liking does not mean that he was going to physically mess with the balls himself, he did not have to, he was the guy that told the refs what the pressure was to be!
- why would the patriots get rid of the ball boys if they were innocent ! That's the dumbest question any writer can ask but I saw it in an article today by some moron. Clearly the Patriots and Brady believe they are innocent as they vehemently have said this. The NFL told him they were going to suspend these guys and as Kraft has mentioned several times, even today, when negotiating sometimes you have to bite the bullet for the long-term good . It was better for the patriots to tell the guys they were being suspended then have the NFL force them to suspend them. Unless Bob Kraft was willing to go to court and fight he had no other choice . This was a joint decision in conversations with the NFL and a way to show the Pats would cooperate in anyway and I sincerely believe that Bob Kraft believed doing what the NFL wanted would eventually lead to Brady been exonerated. A logical person would say that the Patriots would not have fired these guys if anything had happened because the Patriots Are denying anything happened, what logic is there that they would fire people and piss them off that could then come back and rat them out instead of defending these people and then they believe the Patriots are on their side. If you have someone that knows you did something wrong and they work for you would you then fire them in the middle of that investigation or would you make sure that they don't talk buy keeping them on payroll and if the NFL suspends them you fight for them to keep their job! Firing them is more proof logically that thy are innocent!
I wish we had some cornerbacks this year because if We did we would kill everybody this year I still hope we just kill everybody and shut everybody up I am concerned about those cornerbacks

yee has a lot of points butright now two of the biggest media voices in espn and nfln are not entertaining any info from him. He will do radio rounds for the next 5 days but the case from what I have been reading (I may wrong) is going to be about the authority of goodell not about the investigation sham itself. For that Kraft will have to file a suit I think .Unless that happens, this sham investigation will never be exposed.

I wish they publish the whole appeal hearing or leak it even though they agreed to seal it because nfl is not acting on integrity anyway.

People keep saying this, but if they knew it would go to court or there was a realistic possibility of it going to court - then having that come out in court for the first time would be worse than it is now. IMO of course. Ignoring why a celebrity or any person would destroy their phone when they are done using is simply the ignorance of the general non-tech public. Wiping your phone does jack. If you ever used your phone to look at your bank account, took an embarrassing photo, or any thing else that could hurt you either reputation-ally or publicly then you should destroy your phone (i.e. EVERYONE!).
 
FYI:

The Minnesota judge that drew this case also drew the anti-trust lockout case in 2011 and recused himself. Wouldn't surprise me if he recuses himself in this case also.

The Minnesota judge didn't recuse himself. He made an absolute BS ruling saying the case would be dealt with in NY because they filed first.. Only problem with his statement is that, legally, they didn't file first because their filing was incomplete.

Brady is not even going testify in the court room according to NFLPA George Atallah unless he files later for defmation. The current case will be about labor laws I think

Agreed, but if you look at the NFLPA filing, they've still included what amounts to nice slams against Goodell to demonstrate that the process was not fair or impartial

And when I said "Brady's say" I meant via his attorney - though I have every confidence Brady could do a great job arguing the case himself

It's not really Brady who needs to talk - it's his attorneys and they too have generally refrained from what Goodell has done so much of - trying to win this case in the court of public opinion as that's the reason this is happening in the first place - an opportunity for Goodell to rehab a broken image

But I'm seeing various legal experts predicting a 10% chance of success... that being said I think that's a little low as they're talking about situations where a truly independent arbitrator was invovled and due process was generally followed

Not so in this case - in fact very very far from it
 
Next week headlines will read "Tom Brady clubs seals"

Yeah, well, what would you expect from the guy who more probably than not is generally aware that he shot Abraham Lincoln?
