Football players have by far the worst Union of the 3 major sports
No kidding....if this was the MLBPA this would have been over and the MLB huddled in the corner drooling and muttering to itself....
 
All, to help calm your nerves, please read the second page of the letter: http://www.bostonglobe.com/sports/2...GFP/story.html?p1=Article_Related_Box_Article, and also take note that this was a joint submission (so the NFLPA agreed to this schedule).

It provides that by 8/7 (one week from today), the parties will file their cross motions to vacate Goodell's award (NFLPA) and to confirm in (NFL). So in no way has Brady given up his right to sue here, as he will be suing to vacate the award. Indeed, Brady "intend to file later today a public version of an Answer and Counterclaim." So Brady is still suing the NFL. Note that we will all probably be disappointed by what this document contains, since it will redact all confidential materials.

What Brady has given up here is his right to seek a preliminary injunction. I actually think this is preferable, assuming the Court will agree to this schedule. A preliminary injunction, though likely to be granted, carries with it the possibility that the suspension could be re-imposed during the season, which none of us would like. This schedule, again if it is approved by the Court, guarantees that this matter will be adjudicated before the start of the season.

I am a lawyer too (though not a labor attorney), and happy to help answer questions.

Anyone know why this text was crossed out? I didn't (intentionally) do anything to make that happen.

I'm not a lawyer - I have no idea how this works. However, I hope the NFLPA/Brady/their legal teams have learned something here (a bit late but hopefully learned). If they are doing this/agreeing to this with the idea that 'great! we can have a resolution and we can know if he will be playing'. Shouldn't Team Brady be expecting underhanded wrangling and maneuvering to submarine Brady's desire to have clarity before opening day? Whatever dirty underhanded trick they can pull to leave Brady in limbo will be done. So I hope team Brady has one eye on this as the two sides 'agree' to a resolution on this point by X date.

Is he really THAT mentally challengged to believe that his readership is that stupid?

Literally a 6th grade brain thinking he can make stories up at will.

I don't mean to offend anyone with loved ones with learning disabilities and if I do, I apologize in advance but...

I was involved in a labor dispute over 30 years ago that resulted in Expedited Arbitration, as the issue was time limited.. it was not a complicated process, the issue was framed and both sides made argument and then submitted briefs..

FWIW I won..

OTOH this is grossly unfair to the Patriots Franchise.. as they will not know who the opening night quarterback is until the last moment..

The more this evolves the more it becomes obvious the target is BB and #12 is being used to further that goal..
 
I wonder if the judge's ruling on this filing will tell us if he's swayed one way or the other...if this motion is that a negative reflection on the NFLPA's chances, or just another hoop they'll have to jump through (injunction)?

Just throwing the question out there to the lawyer folk...this doesn't worry me per se, but if it's denied then we'll all be holding our breathes while the injunction is pending. That's the last straw, if he can't get an expedited hearing and can't get an injunction he's not going to court, right?

No discovery is needed, per the document, to adjudicate the parties motions, which will be based on the arbitration record. Streamlined.

Discovery was the interesting part to me as I thought that was the means by which new information could come to the table and it would also involve Tom opening himself up to scrutiny which I was going to enjoy throwing in the face of the "CHEATERS!" brigade over here on the Best Coast who insist on taunting me 3-5 times a day whether I ****ing know them or not cause I'm almost always wearing my Pats gear.
