Kessler outlines NFLPA's appeal

I'm not sure if this makes me feel better.... but I guess I should trust that Kessler knows what he's doing
 
The collectively bargained fine seems to be possibly the strongest point in this entire case; the league collectively bargained a fine of $8,268 or so for equipment tampering/stickum, etc. specifically for gaining an advantage. I really don't see how the NFL could argue around this one, other than to say Goodell has the authority to classify the offense and that somehow this offense is more egregious (no idea how anyone would agree.)
 
The card the NFL will play again and again and again is that the CBA stipulates that the commissioner has the right to arbitrate, enforce and dictate player punishment. The players agreed to this.

With that said, the process in which the commissioner follows is that of the wild west.

If that is true, then why even have any collectively bargained fines or even have an NFLPA? I would say more accurately, or at least I really, really, hope, that the CBA stipulates the commissioner has the right to arbitrate, enforce, and dictate player punishment, provided he does not violate the other agreed upon rules of the CBA.

This is absolutely true, too.

However, because Brady was punished for "conduct detrimental", and not an actual violation like an equipment violation or something, that particular punishment can solely be made by the Commissioner. The Commissioner also cannot oversee appeals in which he alone made the punishment.

That's where all the "Troy Vincent did the punishment" "No I did it" "No, I just sat in sometimes" "No I just signed off on it" "No Troy Vincent did it" thing came from.

In my mind, that alone is enough to send the whole thing back to arbitration with a neutral arbitrator, and that's just an objective look at what actually happened.

I thought the NFLPA petition laid it out really well. Goodell could have had Harold Henderson hold the appeal, and told him what to do behind the scenes, and gotten the same result by upholding the suspension, and Brady's case would be much weaker.

But Goodell is simply that arrogant, and that drunk with power, that he had the temerity to hear the appeal as well.

Well Kessler isn't exactly an angel representing Sprewell who choked out his coach lol (and actually won somehow...).

You are right & all of us should trust him. He knows what he is doing. Brady will be OK.

Best analogy; Kessler has completed his Doctorate in Law while the dopes in the NFL front office are still trying to navigate their way through law school.

Kessler was kicking the dogshit out of the NFL when Goodell was still working PR for the Jets.

Yup, these guys are paid the big bucks to sound convincing. Woger's verdict was well-written too.

But Kessler's off to a good start.

Roger's verdict was not well written.. It's was shyte. In fact, it went out of it's way to outright say that Brady knew exactly what was going on despite what the Wells report said. It also make bogus claims about the cell phone information.
 
Over the last few months we have read and seen many reports,writeups ripping the nfl and siding with the pats. But nothing has moved forward in brady's direction yet so I am taking all this with a grain of salt. NFL is too powerful and too corrupt with too much money and people in their pockets that its scary .
