If he is fair and impartial at the least and pro- labor at best then why are people proclaiming a loss already? Because he could be a Jets or Giants fan?

That all that matters. Use simple logic and judge this case fairly.

I remember sitting in a meeting after the Giants beat the Patriots with a client from France and our COO. Our COO was very well educated, extremely intelligent, level headed guy, but from NYC. Our client asked why the Patriots were so hated and the COO went on a long spiel about what cheaters the Patriots are. I had never even heard him discuss sports before after years of working with him. I felt like my head was going to blow. It's amazing how a sports bias can affect even the most level headed people.
 
How can you ignore so many obvious violations? You can't explain your way out of them.

You want to make up for your mistake? PLEASE post and give us something that will make us feel more optimistic ..... this whole thing has gone completely to **** :(
 
I expect he will judge the case fairly with no bias on either side. The way it should be.

I'm not proclaiming a loss, but you have to understand that federal courts struggle mightily to hear their own cases in a timely fashion. They are loathe to set a precedent that would open their docket to reviews of arbitration proceedings that private parties have freely agreed to be bound by. Only if a judge has a real interest in this stuff (Doty) will they try to hold on to the case.

Interestingly he became a Masters Level Social Worker, my profession, after becoming a lawyer so his background is richer than just legal.. not that it means all that much, but he has varied professional interests..

Judge Berman has been a United States District Judge for the Southern District of New York since November 1998, taking senior status in 2011. He received a B.S. degree from Cornell University in 1964, a J.D. degree in 1967 from N.Y.U. School of Law, and a M.S.W. in May of 1996 from the Fordham University Graduate School of Social Service. He received a Diploma of Comparative Law in 1968 and a Diploma of International Law in 1970 from the University of Stockholm Faculty of Law.

Judge Berman was an associate at Davis Polk & Wardwell from 1970 to 1974, and served as the Executive Assistant to United States Senator Jacob K. Javits from 1974 to 1978. In 1978, he became General Counsel to Warner Cable Corporation (and to MTV Networks Inc. in 1984). In 1986, he became a member of LeBoeuf, Lamb, Greene & MacRae and served as managing partner of LeBoeuf Lamb’s Los Angeles office from 1989 to 1991. From May 1995 until his appointment as a Federal District Judge, he served as a New York State Family Court Judge for Queens County.

Judge Berman has lectured on the “Rule of Law” and the “Independence of the Judiciary” in Istanbul, Turkey (2014) and Tirana, Albania (2013). He is the author of “A Team Model to Identify Child Abuse,” “Seven Steps to Protect Children,” and “Community Service for Juvenile Offenders,” published in the New York Law Journal. Judge Berman serves as Chairman of the Southern District’s Media Relations and Magistrate Judges Committees and is a member of the Southern District’s Clerk’s Office, and Mediation Services Committees. He is a member of the New York State-Federal Council and the New York County Lawyers’ Association Family Court Task Force. He has served as an Adjunct Professor at New York Law School and as a member of the New York State Permanent Judicial Commission on Justice for Children.

I'm not underestimating it, I am completely dismissing it because it is nonsense. I don't care if he is a hardcore Jets fan. He won't allow his reputation among his peers to be tarnished due to lack of impartiality simply because he is a Jets fan.

Heh, let's hope you're right. I wouldn't expect him to announce to the world that he's a Jets/Giants fan or recuse himself because of it. But we've already seen the injustices done this team by assumed "impartial, unbiased" New Yorkers acting in official capacity. Just for the hell of it, I'd like to know about this judge's football rooting interests.

At no point in this case have the actual facts and common sense had any bearing on this case, most egregiously the fact that there was no air missing from the balls.

Doubt it all of a sudden starts now.

No way the Pats win this. Will be the biggest miscarriage of justice in the history of professional sports, but it won't matter.

As far as being a liberal judge, doubt he gives a crap about an "employee" who makes upwards of 14 million a year and happens NOT be the primary bread winner in his marriage. And he is probably more likely to go by his feelings then the letter of the law which makes the NY Venue a VERY bad thing!
