Kraft could still sue for team penalties, but he won't, because he's full of it

It seems pretty clear that Kraft told Jerry to suck it up when he got penalized for the uncapped year and it stuck in Jerry's craw. I misjudged their relationship and figured Jerry would not turn on him. But he is upset Kraft talked him out of going nuclear and now Kraft is vocal now that he is on the wrong side of the Goodell punishment.

If it's about PR, it would be smart to do it tomorrow or early Friday, so that it could rule the news cycle throughout Friday and into the weekend. I doubt that'll happen though; I'll be shocked if Kraft actually does anything.
 
If he is that shocked and feels taken advantage of, there is absolutely nothing in the law book that says he can't change his mind and decide to sue the NFL to retrieve his huge fine and loss of draft picks. He never publicly acknowledged any wrongdoing and said he would not sue for the sake of the league; in court, that statement would not be held against him in any way. Unless there is a statute of limitations I am not aware of, I don't see why Mr. Wronged doesn't finally grow a pair and sue, considering now he should be even more damaged than in May. The fact he paid a $1M and suffered irreparable damage to both his brand and his greatest player, and STILL won't sue should tell you plenty.

He is the biggest joke owner I have seen in modern sports; any man who wants to look at himself in the mirror, having just gotten stolen from, lied to, and kicked, would be mounting a court carnage campaign at this very moment, ready to blow up everything from Goodell to Kensil to Irsay. Could you imagine what someone like Jerry Jones or the late George Steinbrenner would be doing this very minute? The league that you help to profit spits in your face, lies to you, and then throws you under the bus in a twisted, coordinated long-play?

Keep up those "moral victory" press statements, Bob. You were dumb enough to think that appeasing "the other 31" would get them to like and respect you. Well, now 0 out of 32 respect you.

Nothing in the law books, just in the NFL’s Constitution, which contains an unequivocal and unambiguous waiver of the NFL owners’ right to sue the league. If Kraft sued the league to get the draft picks back, the NFL would raise the waiver as a defense and Kraft’s lawsuit would be dismissed out of hand. The only thing Kraft would accomplish would be to waste his money and make himself look foolish.

The only way Kraft could get around the waiver language in the NFL’s Constitution would be to argue that the waiver is invalid because the NFL’s Constitution constitutes an unlawful restraint of trade in violation of the antitrust laws. In other words, Kraft would have to challenge the NFL’s antitrust exemption. However, if Kraft were successful in doing that, he still wouldn’t get his draft picks back because there would be no draft. There also would be no franchise tags, no rookie contracts and no restrictions on free agency of any sort. Every player could negotiate whatever contract he could get with any one of the 32 teams. The most successful teams would be wealthiest teams, not necessarily the smartest or best run ones, like the Patriots. Kraft would have succeeded in instantly changing the NFL into the English Premier League and cutting his net worth in half. I would not want the owner of the team I root for to be the kind of hothead moron he would have to be to do that.

There certainly isn't now. The NFLPA is the one who can do damage.

This is what I've been thinking all along. And if he does go after the NFL but loses, so what? Like I've said before, it would cement his legacy in New England and he could ride off into the sunset still a filthy rich man with his honor restored. He doesn't "need" the NFL for anything.
 
Why should any business pursue a fruitless lawsuit with a high probability of failure? Sating the bloodthirst of its fans isn't a viable reason.
I couldn't disagree more; it should be the ONLY reason. But in this case it wouldn't be "sating blood thirst" as much as restoring good faith, integrity and honor. The gesture alone would outweigh any prospective outcome.
 
Can't believe Jerry Jones compares the two penalties. This is such the parade of weasels. There was no loss of draft picks or even a fine for Dallas breaking the salary cap rules which teams were warned ahead of time not to do. The penalty for the Cowboys? They were penalized $10 million against the salary cap ($5 million over 2 years). Essentially, this gave Jones $10 million back into his pocket that he didn't have to spend. He even admits this 'penalty' had almost no effect on his team. Compared with the Patriots' penalty, this is laughable!

Jones said the penalty "impacted to some degree" the Cowboys' plans, but it did not prevent them from signing cornerback Brandon Carr, guards Mackenzy Bernadeau and Nate Livings, quarterback Kyle Orton and linebacker Dan Connor in the first week of free agency.

"Hats off really to (executive vice president) Stephen [Jones]. We have really been able to manage, and I can say we have not missed anything that we wouldn't have done relative to free agency, relative to that cap deduction that we had," Jerry Jones said.

IMO the only way that Kraft can possibly regain the draft picks are the information from the new league rule that will document football PSI's before and during half time.. hopefully this will be recorded in a central place and not conveniently lost.

This will essentially be a longitudinal study of the effects of environmental issues and use... but OTOH will not be surprised if the NFL does not keep all of the records of ball inflation.. or they are misplaced.

Also wonder what was going on in the "heart to hearts" the Goodell was having with Kraft at the league meetings in SF??? Perhaps some promises were made informally that were not kept by the League of Former and Failed Jets Employees(NFL front office)..

Goodell probably told Kraft he has enough owners on his side to boot Kraft from ownership. He probably worded it in a way that said an overwhelming majority of owners are worried and displeased with him. He probably told him as if it were coming from a friend and Kraft bought it. I wouldn't be surprised if that were true. Not even Goodell goes as far as he has in this situation without support. He is acting like he has a mandate, so he probably does.

That's why Kraft came out with his tail between his legs and reassured the other owners he wouldn't rock the boat.

IMO it is very simple, Goodell is an arrogant butthole who believes that he is beyond reproach.. if this does get to Fed Court the depositions will prove interesting.

Kind of like what the NBA did to Donald Sterling. The NBA needs 3/4 of the owners to vote yes to kicking an owner out. I'm not sure about the NFL %age. And that isn't all. You don't just vote to kick an owner. You kick all with a vested interest in the team. That means even Jonathan Kraft would be gone. The team would be sold. Kraft could sue and god knows where that would go. For what it's worth, both Sterling and his estranged wife threatened lawsuits, but eventually relented and agreed to sell before a vote happened. Makes me believe the Sterlings were told point blank they had no shot retaining the team in court.

Didn't the Sterlings have a multi billion dollar on the table as well??

Are you sure that this same rules applies to the NFL Owners?? Comparing Kraft to Sterling is like comparing raisins to grapefruit..

I honestly do not remember the exact wording or anything. I remember someone, somewhere, explaining it a bit when Stephen Bisciotti was getting heat for his roll in the Ray Rice debacle. Their were sports writers over-reacting about the possibility of Bisciotti getting voted out. That's when the Ray Rice thing turned into a Rice cooker for a while.
 
Kraft is supporting Brady in a lawsuit against the league when most here claimed he would try to talk him out of it and some went so far as to claim he would trade him if he went that route, that's a lot more than simply having a press conference. He clearly could have handled this better and he acknowledged that and apologized for it repeatedly, what the f.CK more is he supposed to do right now?

will you let your 'pre judging without all the facts butt' rule your face?
If the man sues he sues if not there's a reason so leave it alone. Haven't you maligned the man enough?

But this begs the question. His outrage is all well and good but it is hollow ultimately. If he got played, what does he intend to do about it that would benefit the New England Patriots?

Yeah, I saw the link to McCann's tweet, but the articles referenced all discuss legal action after a failed appeal. I'm still not seeing what basis Kraft has to file suit if he didn't even bother to appeal.
 
Most of the time that involves undertakings with a reasonable chance of success. On what grounds could the Patriots sue the NFL to reclaim their lost picks that has a chance of success?
