  1. Went out to dinner with family
  2. Enjoyed listening to my mother mocking those who bought Kraft's story
  3. Came home
  4. Read this:

...Prior to the hearing, Goodell had
ruled that Brady and the Union could not question essential witnesses, denied them
access to the investigative files underlying the Wells Report (which were nonetheless
available to the NFL's counsel at the arbitration), and summarily rejected Bradyos
unlawful delegation argument without considering any evidence (other than 'ofacts"
decreed by Goodell himself in his decision). At the hearing itself, Paul, Weiss-the
purportedly o'independent" law firm whose findings about Brady were being
CASE 0:15-cv-03168-RHK-HB Document 1 Filed 07/29/15 Page 7 of 54
challenged-abandoned all pretense of objectivity, and actively participated as counsel
for the NFL conducting direct and cross-examinations of witnesses (including Brady's).
A Paul. Weiss partner represented the NFL for most of the hearing, even though he was a
signatory to the Wells Report and his law partner (Wells) was a fact witness at the same
hearing.

I've been laughing ever since.

I am not nearly involved in law - it seems like the PA is making strong arguments vs the way it was handled. What is the NFL's case going to look like ? Will it be as simple as "the commish has the right to rule as he sees fit according to the current CBA" ? Seems weak considering what I just read.

lol Goodell and gang green couldn't make it anymore obvious they love the Jets.

Honestly cbs news didn't even say Brady hide evidence. I find that as a good thing since Brady has gotten his side out. Honestly I know Brady will win this case. Odds aren't in his favor at all, but who constantly beats the odds?

The best part is, Rodgers could be takin the witness stand in Brady's case with his statement!

So in previous "Gates" the NFL handed over records but in Brady's case they were refused.

C. Commissioner Goodell Refused to Compel the Testimony of Co-Lead Investigator Jeff Pash 143, Judge Jones and Commissioner Tagliabue also set CBA precedents conclusively establishing that players have a fundamental procedural right, in Article 46 appeal arbitrations, to confront the investigators whose work forms the basis for discipline. See, e.g., NFLPA Ex. 166D, Bounty Pre-IU g Order No. 4; c/ NFLPA Ex. 166E, Rice Discovery & Witnesses Order at 2

Why is Kessler talking to Volin of all people? Either way, it sounds like the goal is for it to end up in front of Doty and that makes sense given the number of times the Peterson precedent is cited.

I can't stop laughing either. Every quote from the Brady's team is brilliant. Every time someone posts one I can't help but laugh.

From page 5 of the suit:

The purportedly independent Wells Report was edited by Pash, the NFL's General Counsel, before its public release,

Pash was supposed to be the League's point of contact for Wells and never supposed to be an investigator. If the NFLPA can prove this, this is a huge hit to the NFL. Pash is a paid NFL employee.

From Michael McCann:

One of Brady's best facts is Wells Report wasn't independent. NFL paid for it and Brady now says NFL edited it, too

Man I just made a bet with a guy too on another forum who lives close to me who claims that Brady is a cheater and it will never go to court, hoping to get me an expensive bottle of champagne muahahha.

LOL fellas let's keep posting all night, this is hilarious, i love the comic relief after all this nonsense...

Training camp starts tomorrow and tonight we laugh at the clown commish and his bozo the clowns merry men...does it get any better?!

I want someone, anyone, to find out what happened with the NFL originally enlisting Colombia University to do the science. Did the NFL get results they didn't like and then sought out Exponent?

The Exponent report attachment to Wells report has same date as Wells report. This is impossible as Wells report based on Exponent report.

To my suprise, Breer tweeted this as well. That is NOT a good look for the NFL. Independent is independent. You do not do that. Period. Any decent lawyer would have a field day with that. The instant Pash edited anything it was invalidated. The key will be the proof of editing. If they have that, it's over for sure.

This is the million dollar question the NFL must answer. This is exactly what I heard from someone with Columbia physics department links when I asked them WTF. Perhaps a reporter who was not a lazy person could ask the folks at Columbia Physics department what happened. I mean a list of them all is a click away here http://physics.columbia.edu/people/faculty

According to this filing the NFL has about a dozen CBA violations and counting.

Wasn't the exponent science right though if we go by Walt Anderson's recollection of the events?

I can't wait for the haters crying that the Minnesota court is on Kraft's payroll.

I don't have the links but Florio destroyed the exponent report and said it was trash.

This is very readable and covers everything we have all been talking about plus it adds some new and interesting facts. For example, it lists several instances where players on other teams were generally aware of others' rule violations (Jet kicker, Incognito team mates, Bountygate) but were not sanctioned by the league. This precedent is what constitutes Rule of the Shop. Other salient points are that players must be advised of the consequences of breaking a particular rule, which Brady was not, and that equipment tampering applies to teams and not to individual players.
