“They shifted from PSI to the new shiny object, the cell phone,” said Yee. “We expected this. Because this was the easy way to pivot off the junk science and get off the PSI issue. And we knew that from a newsworthiness standpoint, the general public might be easily fooled. But in the coming days -- just like the Wells Report being picked apart after its issuance -- the same thing happens with this.”

Speaking for more than 30 minutes, Yee detailed the decision-making process and attempts at transparency the Brady camp went through when the appeal landed on the desk of Roger Goodell and was out of the hands of Ted Wells.

Yee said Brady cycled through the cell phone he had used in the months from November through March after returning to the country from celebrating the Super Bowl victory when he was looking to upgrade to an iPhone 6. He said that Brady offered to provide detailed records to the NFL from AT&T that indicated where every call and text message were sent, and that the league in fact had access to the degrees of communication he would have had with the two Patriots employees at the heart of the probe: Jim McNally and John Jastremski.

"Tom's phone billing record from this timeframe shows that he never spoke on the phone or texted with McNally, ever," Yee said. "Tom's phone billing record shows that nearly every communication with Jastremki was already in possession of Wells' team with exception of three texts between Tom and Jastremski on Feb. 7. Every other communication he ever had with Jastremski in that time period was already in the hands of Wells' team. They also had any communication between Tom and the equipment manager (Dave) Schoenfeld."

I get worried, because it's hard to believe that Goodell is really so stupid. This has become a ginormous cluster-****, which gets ginormouser ever day to the extent that it's hard to comprehend what the League Office could be thinking.

Goodell's plan to have this heard in New York has now apparently backfired on him, because the case has apparently been assigned to a Senior Status judge who worked for Jacob Javits, was appointed to the Federal Bench by Bill Clinton, has an MSW in addition to his JD and, to top it all off, studied International Law in Stockholm. In other words, a Labor Union's wet dream.

Does Goodell know something we don't or is he just as dumb as he seems?

I keep saying it, and Goodell keeps demonstrating that I'm right:

Goodell is a True Believer and a crusader. Logic and facts are irrelevant once he believes something. Remember, this is the guy who demanded a lower standard of guilt in all this stuff.
 
NFLPA has to be more patient next lockout. If losing a season prevents crap like this then it's worth it.

The league looks great right now. Goodell went hard after perhaps the biggest star in the league, never backed down, and had his belief (and that of many others) confirmed that Brady had something to hide when he erased the phone. The story that has been written is that the Brady did SOMETHING (what it was is unimportant), lied about it, destroyed evidence and proved Goodell right for taking a principled stand from day 1. It is unlikely that any federal court decision is going to change this narrative, even if Brady gets the suspension reduced or overturned. Barring a miracle, it's really all over but the shouting.

And if you, Don Yee, played any role at all in advising Brady to disclose that no-need-for-the-league-to-know-info to the NFL then Mr. Brady needs to fire you immediately.

You KNEW Goodell and Co. were/are dishonest media leaking snakes and YOU volunteer, you cough up info you never had to cough up about destroying a phone???

Kessler got Latrell Sprewell out of trouble after he friggin choked his coach in front of his team. He's got a shot at ANYTHING. If anybody else could have gotten OJ out of trouble it would probably be Kessler.

This is one of the most uninformed chicken little posts I have ever seen.
 
Is the lower standard of proof needed to punish something that is written in the CBA or something Goodell determined and decides to implement under the powers given him in the CBA?

I assume that you are a lawyer, with extensive experience in cases involving major sports leagues. But do you think it is possible that providing the NFL with this information was not a huge gaff by Brady and Yee, but was in fact a calculated decision by a team of lawyers employed by Brady and the NFLPA. I don't want to question your legal aptitude, but Jeffery Kessler has a hell of a track record, and was on the NFLPA/Brady payroll for a month before they told the NFL about the phone.

I'm not willing to accept that the phone was actually "destroyed" as opposed to just the data was deleted, but in either event, The mistake was to delete the data or smash the phone, whichever version is true, as opposed to just putting it away in a safe somewhere or safe-deposit box. Once that was done, if you are headed to court, and if the other side is allowed to do discovery, you might have to say it then. Better to get it out now.
Legally Brady had every right to do what he did with his phone. Just doesn't play well in the court of public opinion.
