I just heard on WEEI that the league has to re-file their lawsuit because whoever filed it forgot to sign the paperwork before submitting it. If I am the NFLPA, I am running up the steps of the MN courthouse to be first to file.

Ha! So much for Goodell big bad lawyers out-smarting TB and beating him to the punch.

Forgetting to sign sounds like nervousness.

Well just add this to the list of what Kessler will be arguing.

"Your Honor, the nfl was in so much of a rush to file this that they didn't properly file it the first time and had to refile it"

oh Christ, this is the judge who ordered the guy to wrote the anti-Obama book to get "mental counseling"

obvious judge shopping here

But this will be good in the argument by the NFLPA in the jurisdiction argument since the NFL rushed so fast to venue shop in response to the fact that they knew that the NFLPA was going to file and they wanted to beat them for the venue.

So this means it will be held in new york ?

No. There will be a jurisdiction hearing. The NFL will argue since they filed first, NY has jurisdiction. The NFLPA will argue the only reason the NFL filed first is because they knew the NFLPA would file in MN and the NFL was venue shopping. The file first rule is usually voided in cases like this.

How does the NFL even have standing to file anything? It's Brady who is the aggrieved party and until he files, I don't see how the NFL has any claims.

I'm pretty sure they still randomly assign the judge when the matter is filed.

I also assume the NFLPA couldn't file until the arbitration ruling was announced and only the NFL* knew when it would be announced and thus have an unfair advantage by knowing the timing and being able to have all of their ducks in a row.
